Becker Büttner Held ( BBH for short ) is an international law firm with offices in Berlin , Munich , Cologne , Hamburg , Stuttgart , Erfurt and Brussels . A total of around 180 lawyers, auditors, tax consultants and engineers work for BBH. The law firm's focus is on energy and infrastructure law, public law , corporate and tax law , competition and antitrust law , environmental law as well as copyright and industrial property rights .

BBH advises a total of around 450 municipal companies and municipalities, including both energy suppliers and network operators. The law firm assists cities and municipalities with the award of concessions and subsequent remunicipalisation . In addition, power plant developers and operators, transport and infrastructure companies, real estate companies, the public sector, banks, energy traders, energy-intensive companies, medium-sized companies, collecting societies and authors are among BBH's clients. In terms of energy policy, the law firm is regularly involved in the form of expert work for ministries and expert work in the German Bundestag.

BBH represented a number of green electricity providers and municipal utilities with an annulment suit against the EU Commission for granting aid to the British nuclear power plant at Hinkley Point. As part of the discussion about state subsidies for the Hungarian nuclear power plant project PAKS II, BBH addressed an official statement to the EU Commission in February 2016, in which it questions the legal basis for state aid. The State of Berlin supported BBH in awarding the electricity and gas concessions, but also in awarding the charging infrastructure for electric vehicles. BBH represented the federal government in the dispute over the nuclear fuel tax . The state of Lower Saxony has one in Amtshaftungsklage of E.ON because of the nuclear moratorium advise and represent them in court. BBH is also involved in the procedure for the constitutionality of the nuclear phase-out before the Federal Constitutional Court , as it represents three federal states (Rhineland-Palatinate, North Rhine-Westphalia, Hanseatic City of Bremen). On behalf of the Federal Ministry of Economics , BBH presented a legal opinion on nuclear provisions, and another on security of supply with natural gas. BBH advised around 109 municipalities on the takeover of 35 percent of EAM, the former E.on Mitte group.

BBH partner Ines Zenke was one of 19 full members of the commission to review the financing of the nuclear phase-out (KFK), which the federal cabinet decided to set up on October 14, 2015 and which presented its final report on April 27, 2016.

Through a connection to the BBH AG accounting firm BBH also offers conditional tasks of auditing on. In contrast, the energy industry advice is provided by the subsidiary Becker Büttner Held Consulting AG. BBH Immobilien GmbH & Co. KG, based in Munich, complements BBH's consulting services in the real estate sector. Together with the Becker Büttner Held law firm, these companies form the so-called BBH Group.

history

Founded the law firm of Peter Becker and Wolf Büttner as "Becker Büttner & Partner" in 1991 in Berlin as part of the " current dispute ", whose mandate had taken Becker on behalf of 146 municipalities: By comparing before the Federal Constitutional Court received on December 22, 1992 East German municipalities have a right to electricity and gas assets in their respective municipality and the right to set up their own municipal utilities. An oligopolistically designed supply structure under the control of the large German network companies could thus be prevented in favor of a pluralistic energy industry. Due to these historical roots and the commitment in the municipal economy sector, BBH is also known as "the public utility company". Christian Held joined the partnership in 1992 and became the third name partner in 1997. Since then the firm has been operating under the name of Becker Büttner Held. In 2002, BBH merged with the law firms Dreyer & Böck and von Weidenbach and colleagues, adding the location in Munich. In 2006, Peter Becker left BBH as a liable partner. Another office was opened in Cologne in 2006, an office in Stuttgart in 2007 and a location in Brussels in 2011. In 2013, BBH merged with the Hamburg energy law firm Kuhbier Rechtsanwälte. Since then, BBH has also had an office in Hamburg. In 2017 an office was opened in Erfurt.

Awards

In the years 2013 to 2017, BBH was named "Top Business Law Firm" by the news magazine Focus , and in the years 2014 to 2020 it was also named "Top Tax Law Firm" for the energy industry. In the ranking of Legal 500 from 2016, BBH and another law firm took 1st place in the energy sector. Christian Theobald is mentioned as a leading name in the energy sector . Together with Christian Held, he was named one of “Germany's best lawyers” in energy law in 2015 and 2016 and together with Ines Zenke for 2017 and 2018 in a ranking by the Handelsblatt and the US publisher Best Lawyers . In 2019 Christian Theobald, Ines Zenke and Stefan Missling were honored here. In 2020, 12 more colleagues were recognized by BBH as the best lawyers in Germany. In 2018, BBH was named “Law Firm of the Year for Energy Law” by JUVE. Manager Magazin ranks BBH among “Germany's best auditors” for medium-sized companies in 2019 and 2020/2021. The business magazine brandeins ranks BBH among the best business law firms in 2020 and among the best tax consultants and auditors.
