The Federal Commissioner for the Victims of the SED Dictatorship at the German Bundestag (often SED Victims Commissioner for short ) is an auxiliary body of the Bundestag . The office of victim commissioner was created on June 17, 2021 on the basis of the SED victim commissioner law ( OpfBG for short ). The first and current victim commissioner is the former GDR oppositionist Evelyn Zupke .

With the establishment of this office, the Stasi records authority was dissolved and the records were transferred to the Federal Archives .

According to Section 1 of the SED Victims Commissioner Act, the Victims Ombudsman serves as an ombudsman for "the victims of the SED dictatorship and communist rule in the Soviet occupation zone in Germany and the former German Democratic Republic", advises the Bundestag and public authorities on this issue and takes fulfilling further tasks.

The first incumbent, Zupke, described the office as "a mediator and bridge, also between victims and politics - a point of contact for both sides". She also saw it as a possibility for the victim ombudsman to “bring in bills ”.

organization

The victim commissioner is organized as an auxiliary body of the Bundestag. According to Section 5 (1) of the SED Victims' Commissioner Act, it is independent and is only subject to the law.

According to Sections 5 to 6 of the Act, the victim ombudsman is elected by the German Bundestag for five years and then appointed by the President of the Bundestag . Re-election is possible once. The minimum age is 35 years; Employees of the former Stasi and similar persons are excluded. Before the end of his term of office, the victim ombudsman can only be dismissed by the President of the Bundestag if he resigns or if the Bundestag removes him with an absolute majority . Similar to members of the Federal Government , the Victims ombudsman must continue his duties (at the request of the President of the Bundestag) after the end of his term of office until a successor is appointed.
