The Federal Agency for Railway Accident Investigation ( BEU ) is an independent federal investigative body that carries out investigations into serious accidents in railway operations in Germany to determine the cause of the accident and, if necessary, issues recommendations to avoid future accidents. It can also take action in the event of dangerous incidents that could have led to a serious accident, provided that there are sufficient indications. The BEU is an independent higher federal authority in the portfolio of the Federal Ministry of Transport and Digital Infrastructure . BEU is based in Bonn. Its English name is Federal Authority for Railway Accident Investigation .

The BEU was set up in 2017 and is the successor authority to the Federal Railway Accident Investigation Center (EUB), which was set up in 2008 and which was assigned to the Federal Ministry of Transport and Digital Infrastructure in the Railways Department.

Legal basis

The work of the BEU and its predecessor authority EUB is based on the EU Directive 2004/49 / EC (Railway Safety Directive) of April 29, 2004 and its new version of 2016/798 of May 11, 2016. a. ensure that in the event of a serious accident (as defined by the Directive: accidents with at least one fatality, at least five seriously injured persons or damage estimated by the investigating body at at least two million euros), a safety investigation by one body, regardless of a judicial investigation which does not lead to a conflict of interests through relations with the actors in the railway sector. In particular, their functional independence is required from the national safety authority or regulatory body responsible for the railway sector, i. H. in Germany by the Federal Railway Authority .

According to the directive, the member states of the European Union are obliged to ensure that the investigation body carries out an investigation after serious accidents.

Specifically, Directive 2004/49 / EC states that an investigation body is to be set up:

'Member States shall ensure that the accidents and incidents referred to in Article 19 are investigated by a permanent body which has at least one investigator who is able to act as investigator in the event of an accident or incident. This body is organizationally, legally and in its decisions independent of infrastructure managers, railway companies, charging bodies, allocation bodies and notified bodies as well as of all parties whose interests could conflict with the tasks of the investigating body. It is also functionally independent of the safety authority and the regulatory bodies in the railway sector. "

The implementation of the directive 2004/49 / EG in Germany took place with the fifth law amending railway regulations (5. EisenbRÄndG) of April 16, 2007 as well as the second regulation to enact and amending railway regulations of July 5, 2007. The tasks of BEU result from the General Railway Act (AEG) and the Railway Accident Investigation Ordinance . With the 5th EisenbRÄndG the AEG was changed with reference to the EU directive. The establishment of the EUB in accordance with Section 5, Paragraph 1f of the General Railway Act took place with a decree of the Federal Ministry for Transport, Building and Urban Development on August 20, 2008. The BEU was established as the successor authority with a decree of the Federal Ministry for Transport and Digital Infrastructure dated 14. July 2017.

The staffing of the predecessor authority of the Federal Railway Accident Investigation Office was 21  posts in 2015. In the 2019 budget, there were 30 posts for civil servants (2 ×  higher service , 27 ×  higher service , 1 ×  medium service ) and two posts for employees (2 ×  TVöD E13 ) expelled.

The department of principles and administration and the department of examination unit are subordinate to the management of BEU. Four areas of investigation are subordinate to the latter:

  • Northwest UB: Lower Saxony, North Rhine-Westphalia, Bremen. Seat: Essen.
  • Northeast UB: Schleswig-Holstein, Hamburg, Mecklenburg-Western Pomerania, Berlin, Brandenburg, Saxony-Anhalt, Thuringia and Saxony. Headquarters: Berlin.
  • Southwest University Library: Hessen, Rhineland-Palatinate, Saarland and Baden-Württemberg Headquarters: Mannheim.
  • Southeast UB: Bavaria. Headquarters: Munich.
