Claire Huguenin

Claire Huguenin (born March 12,  1954 in Lucerne ; † June 27, 2018 in Zurich ) was a Swiss lawyer and lawyer of obligations . As a professor for private, commercial and European law, she taught at the University of Zurich .

academic career

Huguenin studied and did his doctorate at the University of Bern (lic. Iur 1980, Dr. iur. 1984 with Wolfgang Wiegand on the subject of initial contract defects). In 1985 she was admitted to the Zurich bar and in 1987 an LL.M. from Columbia University and an LL.M. from the University of Amsterdam . In 1994 she completed her habilitation at the University of Zurich with a paper on the principle of equal treatment under company law . From 1997 she held the chair for private, commercial and European law at the University of Zurich (semi-official until 2000), from 1997 to 2000 she was also a professor at the University of Bern. From 2001 she was a permanent visiting professor at the University of Lucerne .

Her research focus was on Swiss and European contract and company law. As part of a research project of the Swiss National Science Foundation (SNSF), she and Reto M. Hilty presented "OR 2020", a draft for a modernized general part of the Swiss Code of Obligations (OR) in 2012. This was accepted in 2013 through two postulates , each of which was signed by a majority of the National Council and the Council of States . In 2018, the Federal Council announced in a report that it saw no need for action for a complete revision of the general part of the OR.

practical activity

Until her appointment to the university, Huguenin practiced as a lawyer . During her career, she was, among other things, Vice-President of the Swiss Takeover Commission , Vice-President of the Equal Opportunities Commission at the University of Zurich and a member of the federal corporate governance working group, which wrote the expert report on the partial revision of company law in 2003. She was a founding member of the Competence Center Medicine - Ethics - Law Helvetiae MERH, the Center for Art and Law and the European Law Institute at the University of Vienna .

Awards

In 2016 she was awarded the Great Walther Hug Prize .
