Daniel Krause (born May 6, 1980 in Minden ) is a German political activist , author and teacher . Between 2013 and 2015, he won several lawsuits regarding the freedom of expression of civil servants .

Career

Krause studied at the University of Münster the subjects German , social sciences and education to become a teacher and was his supervisor, to become known as a critic of religion in 2007 sociologist Horst Herrmann , with a dissertation on the radio show Domian doctorate. The University of Münster withdrew his doctorate from him. Later, Krause became a high school teacher in the school service of the state of North Rhine-Westphalia.

Krause was critical of religion within the framework of secularly oriented associations such as the Freethinkers Association of Austria or the Central Council of Ex-Muslims . At events he appeared as a speaker together with well-known critics of Islam such as Serap Cileli and Ahmad Mansour ; he also published as a book author and blogger . In 2016 he ran the magazine Gaystream together with theologian David Berger as its deputy editor-in-chief .

School principals assessed Krause's suitability as a teacher positively, but the school authorities criticized his political activism. Krause was suspended from classes twice because of this , and he won against both times in court.

Positions

The Münster Administrative Court classified Krause's political positions as “left” and thus followed its own location.

In order to “defend women's rights , children's rights , LGBT rights and also animal rights ”, Krause publicly speaks out against “ sexist , authoritarian , homophobic and also speciesist influences of Christianity and other religions”. His heart has been beating “ secular-humanistic ” since his youth , the time with his doctoral supervisor Horst Herrmann has given this academic background and strongly shaped his development. Krause advocates “the unrestricted right to active euthanasia and also the unrestricted right to abortion in the sense of self-determination about one's own body”.

According to Krause, the central characteristic of Christianity and Islam is totalitarianism ; in this orientation both religions are comparable with communism and national socialism . None of these belief systems tolerated individualism , people were "sacrificial animals" for the collective . Sexism and homophobia are fed from this, since the individual sensation of pleasure makes every collective unpredictable. In totalitarianism, sexuality should only serve "to give a child to the authorities", never as an expression of joy in oneself or in others.

With regard to school lessons , Krause expressly advocates gender mainstreaming and addressing homosexuality and transsexuality . He advocates legal action against parents who try to oppose this. He criticizes the content of Islamic religious instruction in North Rhine-Westphalia as "anti-constitutional", and the Ministry of Education disregards the Basic Law by including radical Muslim associations.

Legal successes

Krause successfully defended himself against legal action by the Arnsberg district government in several court cases .

Acquittal of the charge of Islamophobia

Krause won against his first suspension before the Gelsenkirchen Administrative Court in June 2013. In September 2013 he was also right in the second instance, the North Rhine-Westphalia Higher Administrative Court . The school authorities had issued the suspension in June 2012 on suspicion that Krause's public statements violated official and civil service regulations. The teacher had previously announced in a public speech that he was “more afraid of Islamists than Nazis” and that Islamist parents wanted to influence school lessons.

To support Krause, scholars and representatives of the association critical of religion, such as the historian Egon Flaig , the neo-Marxist Hartmut Krauss and the human rights activist Mina Ahadi, published a call for solidarity and criticized Krause's suspension. In her opinion, Krause had "quite rightly pointed out the threat and elementary violation of rights that orthodox and radical forces of Islam pose for women and gays". Krause "never attacked Muslims across the board, but explicitly referred to violent parts of Islamic believers who violated fundamental rights and human rights, always differentiating between Islam on the one hand and specific Muslims on the other."

In May 2014, Krause won a court order against a disciplinary order in this matter. The Münster Administrative Court came to the conclusion that Krause's speech “does not condemn or attack Islam, only Islamism”. The judges were convinced that the fact that he had made these statements at an event of the Pro NRW party was "spontaneous". In contrast to what the press said, Krause clearly distanced himself from anti-constitutional tendencies in favor of NRW in his speech.

Treating LGBT issues in class

In May 2014, the Münster Administrative Court granted Krause the right to address homosexuality in class from the 5th grade in the way he practiced. In addition, the judges allowed him to take drastic speeches against homophobic tendencies among schoolchildren and, under the given conditions, to make threats against legal guardians. In 2012, Krause threatened the mother of a fifth grader in a letter with criminal and civil law consequences and wrote to her literally: “Parents who torpedo school efforts against homophobia are to be sanctioned with similar consequences as those with parental authority who, for example, attempt to combat racism at school and torpedo anti-Semitism . ” The school authorities had rated Krause's behavior as inappropriately“ escalating ”and criticized a“ mixture of professional and private interests ”. The court, however, found that Krause's actions were an appropriate response to the student calling homosexuals "perverts" in class.

Acquittal of the charge of sedition

On January 27, 2015, Krause said on WDR that he would rather deal with IS terrorism, Islamism and animal welfare issues than Auschwitz . As a self- confessed vegan , he also said : “Six million animals die every 20 minutes, that's a lot closer to me emotionally!” These statements again led to a suspension, but Krause also sued successfully in court. After a criminal complaint by the district government for incitement to the people , Krause was acquitted of this accusation by the Cologne public prosecutor : According to the judicial authority, Krause's statements did not contain any criminal qualification of the Holocaust. Following this judgment, Krause reaffirmed his stance as an animal rights activist in the press: there is a clear connection between violence against animals and violence against people, and meat consumption has a lot to do with crimes against humanity.

Tenure for life

Krause achieved another legal success in November 2015, when the Administrative Court of Gelsenkirchen obliged the State of North Rhine-Westphalia to appoint him as a civil servant for life from August 2013 retrospectively . The court confirmed that the statements made by Krause were covered by the constitutionally protected freedom of expression.
