Monument Advisory Board

A monument advisory council or monument council is a voluntary body constituted according to the respective monument protection law , advising the executive in matters of monument protection and monument preservation .

Germany

Due to the cultural sovereignty of the federal states, there are different regulations in Germany.

" Monument councils " or " state monument councils " advise the highest monument protection authorities and monument specialist authorities (state level). They are in the monument protection laws of Baden-Württemberg (§ 4), Bavaria (Art. 14), Berlin (§ 7), Brandenburg (§ 18 (1), here: " Advisory Board for Monument Preservation "), Bremen (§ 6), Hamburg (Section 3), Hesse (Section 5), Lower Saxony (Section 22), North Rhine-Westphalia, Rhineland-Palatinate (Section 26, here: "Landesbeirat"), Saarland (Section 5), Saxony (Section 6), Saxony-Anhalt (Section 6 (3, 4)), Schleswig-Holstein (Section 4) and Thuringia (Section 25).

" Monument Advisory Boards " usually advise the lower monument protection authorities (district level). They are only provided for in the monument protection laws of Brandenburg (Section 18 (5)), Hesse (Section 3 (3)) and Thuringia (Section 22 (4)). In North Rhine-Westphalia (§ 23 (2)) a " monument committee " should be formed for each of these tasks . In Bavaria, voluntary advice to the lower monument protection authorities is to be carried out by " home keepers ", in Lower Saxony, Saarland, Saxony and Saxony-Anhalt by " commissioners " and in Rhineland-Palatinate by " voluntary monument conservators ".

Austria

The Monument Advisory Board is an advisory body provided by the Federal Ministry for Education, Art and Culture to the Austrian Federal Monuments Office in matters of monument protection and preservation . It consists of representatives of relevant disciplines such as art history , architecture , history (general history, history of technology , economic and social history, etc.), archeology , prehistory and early history , urban planning , spatial planning , structural engineering , statics , geology and soil mechanics , business administration , construction ( Cost calculation), real estate , as well as monument preservation, restoration and conservation . They exercise their function on a voluntary basis and are appointed by the minister for a period of six years. Permanent members can be sent by the Federal Minister for Economic Affairs and Labor , the Federal Architects and Engineers' Chamber as well as the Art Senate. The members provide advice to the Federal Monuments Office as well as to the ministry (on issues relating to the award of the Austrian Monument Fund in accordance with Section 33 DMSG ), also individually as consultants and experts . The body also joins relevant committees. For individual tasks, non-permanent, only advisory members of the property developers and corporations concerned are appointed, for example one representative each from the federal state and the municipality , tourism by the Chamber of Commerce , in the case of church property a representative of the legally recognized church or religious society concerned , or representatives of associations whose aim of the association is to preserve cultural assets (§ 7 Ordinance on the Monument Council). If an immovable monument is destroyed - except in the case of imminent danger or ground monuments  - the monument advisory board is to be heard ( § 5 DMSG).
