criticism

For the construction of the Mall of Berlin , which opened in autumn 2014, in addition to the four-month delay, fire protection deficiencies and the bankruptcy of the general contractor, various subcontractors cheated on the construction workers for their wages on behalf of HGHI Leipziger Platz GmbH. Accordingly, the mostly Romanian workers were allowed to work for 10 hours a day for an hourly wage of just under 6 euros. Ultimately, the construction workers' wages weren't even paid in full. After a construction worker, the workers were withheld written employment contracts and in some cases no accommodation was provided.

Investor Harald Huth's “HGHI Leipziger Platz GmbH” commissioned the construction of the Mall of Berlin . The “Arbeitsgemeinschaft Leipziger Platz N ° 12” carried out the contract under the management of the now insolvent “Fettchenhauer Controlling und Logistic GmbH”. The subcontractors “Metatec-Fundus GmbH & Co. KG” from Berlin-Kreuzberg and “openmallmaster GmbH” from Frankfurt am Main were directly responsible for the wage fraud . Ultimately, however, the main responsibility lies with the client of "HGHI Leipziger Platz GmbH" of the investor Harald Htuh. This main responsibility also exists in accordance with the law on mandatory working conditions for cross-border posted workers and for employees regularly employed in Germany of the Employee Posting Act - AEntG in Section 14 Liability of the Client. The DGB first made the case public on October 31, 2014, which is why the Mall of Berlin received increased media attention in November. Because of this, the scandal and the Mall of Berlin was nicknamed Mall of Shame.
