Hartmut Schwan

Hartmut Schwan (born October 4, 1951 in Fulda / Bronnzell ) is a German lawyer and was President of the Thuringian Higher Administrative Court as well as honorary professor at the Friedrich Schiller University Jena .

Life

Schwan studied law and economics at the Philipps University of Marburg . In 1979 he completed his law studies with the first state examination, but did not complete his studies in economics. He became a research assistant at the Institute for International and European Law at the Philipps University of Marburg and received a scholarship from the State of Hesse . In 1983 the second state examination followed after the legal clerkship . During his legal clerkship, he completed his doctorate in 1982 .

In 1984 Hartmut Schwan began his legal career in the ordinary jurisdiction at the Kassel District Court and then at the Fritzlar District Court . In 1987 he moved to the Kassel Administrative Court and thus to administrative jurisdiction .

In the course of reunification , on September 1, 1990, Schwan moved from the Kassel Administrative Court to the Gera District Court as a construction assistant for the administrative courts of Thuringia . From December 1990 he was entrusted in the Thuringian Ministry of Justice with the development of the Thuringian administrative judiciary, but also with questions of the organization of the ordinary jurisdiction and the establishment of a judicial examination office. After the re-establishment of the Weimar Administrative Court in 1993, he was appointed its first President. On April 1, 2004 he became President of the Thuringian Higher Administrative Court in Weimar . There he was chairman of the 1st Senate responsible for building , environmental and educational law until his retirement . Since the establishment of constitutional jurisdiction in Thuringia in 1995, he was a deputy member of the Thuringian Constitutional Court, first until 2005, and then until 2019 . Klaus Hinkel succeeded him in office at the Constitutional Court and as President of the Thuringian Higher Administrative Court .

In addition to his work as a judge, he started teaching at the University of Jena in 2004 and became an honorary professor for constitutional and administrative law at this university in 2011. Schwan was editor of the Thuringian administrative gazettes from 1993 to 2006 and was co-editor of the administrative gazettes in 2007. He published mainly on police and regulatory law as well as building law.
