Manfred Baldus (born May 25, 1963 in Marienhausen ; † before or on December 30, 2021 ) was a German legal scholar , university professor and constitutional judge .

Life

Baldus studied law , political science and philosophy at the universities of Trier , Bonn , Paris and at the Free University of Berlin from 1983 to 1988 . After his first state legal examination in 1988, he did community service at the Eppendorf University Hospital in Hamburg in 1990 . From 1991 to 1993 he took part in the Graduate College for Legal History at the University of Frankfurt as a doctoral scholarship from the Volkswagenwerk Foundationpart. From 1993 to 1995 he did his legal preparatory service, which he completed with the assessor exam. During the clerkship Baldus in 1994 at the University of Frankfurt on the unity of the legal system - meaning a legal formula in theory of law, civil law and state law of the 19th and 20th centuries doctorate .

From 1996 to 1998, Baldus was a post-doctoral fellow from the German Research Foundation . In 1998 he completed his habilitation at the University of Frankfurt on the subject of transnational police law - constitutional foundations and simple legal structuring of police powers to intervene in cross-border issues for public law including European law , legal theory and recent legal history . In 1998 and 1999 he was a research assistant at the Faculty of Law at the University of Rostock and from 2000 to 2003 senior research assistant at the University of the Federal Armed Forces in Hamburg . During this time he held professorial positions at the universities of Frankfurt and Kiel . He was also visiting professor at the University of Paris X in 1999 .

In 2003, Baldus was appointed university professor at the newly established political science faculty at the University of Erfurt . There he held the chair for public law and modern legal history. In 2008 he turned down a call to the German Police University . From 2015 to 2016 he was also head of the expert commission for the evaluation of the Thuringian police structural reform, taking into account the structure and working methods of the State Criminal Police Office. Until 2021 he was chairman of the investigation committee according to the code of ethics of the University of Erfurt.

Baldus was a member of the Thuringian Constitutional Court from 2008 . His term of office was extended for a further five years in 2012 and a further seven years in March 2018. Most recently, the election took place at the suggestion of the parliamentary groups of the CDU , SPD , Bündnis 90 / Die Grünen and Die Linke . He received 77 out of 85 votes in the Thuringian state parliament in a politically difficult situation.

Baldus died during his tenure in late December 2021 at the age of 58. Prime Minister Bodo Ramelow praised him as a “strong advocate for the rule of law”; Interior Minister Georg Maier recognized him as a “voice of the rule of law and democracy”.

Baldus dealt with German constitutional law , legal theory , Thuringian state law and police law . A special focus was on human dignity and Article 1 of the Basic Law for the Federal Republic of Germany .

Memberships and honors

Baldus was a member of the Association of German Constitutional Law Teachers and of the Internal Security Working Group . From 2021 he was a member of the Scientific Freedom Network .

In 2001 he was awarded the 1st prize of the Police Leadership Academy in 1999 for excellent essays in the field of internal security for his habilitation thesis.

In 2003 he was awarded the Prize for Good Teaching in the Studium Fundamentale of the year 2003 from the Universitätsgesellschaft Erfurt e. V. and the student council of the University of Erfurt . He received further awards for good teaching, for example from the student body of the political science faculty in the winter semester 2016/2017 and in the summer semester 2017, each with second places.

Litigation representation

In 2002 Baldus took over the legal representation in the oral negotiation of a norm control procedure that was presented to the Federal Constitutional Court by the Hamburg District Court. In the underlying case, Baldus opposed the ban on double names for children by Section 1616, Paragraphs 2 and 3 of the BGB a. F. and wanted his child to be allowed to have a double name made up of his name and that of his wife, who kept her surname after the marriage. The First Senate of the Federal Constitutional Court ruled the matter negative.

Athletic career

Before his legal career, Baldus was active as a footballer and played a total of 21 competitive games for VfB Wissen in the 1983/84 season of the Verbandsliga Rheinland (then the fourth highest division in German football) . He also played several times for the German A youth national team of the German Football Association .
