Johannes Struckmann

Johannes Gerhard Moritz Struckmann (born March 23, 1829 in Osnabrück , † May 12, 1899 in Cologne ) was a lawyer and member of the Reichstag .

Life

Johannes Struckmann, son of Gustav Wilhelm Struckmann , a counselor in Osnabrück. His brothers were the future mayor Gustav Struckmann in Hildesheim and the higher regional judge Hermann Struckmann in Kiel , who was also involved in the codification of the civil code .

He studied law at the universities of Heidelberg, Berlin (where he belonged to the old fraternity Germania) and Göttingen (here he became a member of the fraternity Hannovera in 1848 ).

In 1851 he entered the civil service of the Kingdom of Hanover . After the end of the German War in 1866 he was accepted into the Prussian judicial service; this was the beginning of his extraordinary career for a so-called Must-Prussian. In 1867 he was commissioned as a senior court assessor to deputize for the crown attorney at the Hanover Higher Court, and a short time later he was appointed senior judge at this court, and in 1870 he worked at the appellate court in Cologne. In 1872 he was transferred to the Prussian Upper Tribunal in Berlin as senior tribunal advisor . In 1878 he became a senior administrative judge. After the fundamental judicial reform in Germany, he was the first President of the Hildesheim Regional Court in 1879. In 1886 he was President of the Kiel Higher Regional Court for six months, then from 1887 until his death President of the Cologne Higher Regional Court.

Johannes Struckmann was also politically active. As a member of the National Liberal Party , he belonged to the Prussian House of Representatives from 1867 to 1870 and to the German Reichstag for the constituency of the Province of Hanover 5 (Melle, Diepholz) from 1874 to 1878 . He was an employee of the Reich Justice Commission and worked on various drafts of new Reich laws submitted to the Reichstag after 1871.

His two-volume Commentary on the Code of Civil Procedure, initially edited together with R. Koch, was a standard work in which other authors soon participated. The 10th edition, which appeared in 1910, long after his death, was published under his name. As President of the Higher Regional Court in Cologne, he successfully endeavored to hold lectures on the emerging civil code in the local legal association .

Honors

  • In 1879 he received the title of Privy Chief Justice. In the same year, the Law Faculty of the University of Leipzig honored him by awarding him an honorary doctorate.
  • In 1890 he was awarded the title Real Privy Council with the rank of First Class Council with the predicate Excellence .
