Cantonal Council (Schaffhausen)

The Cantonal Council of Schaffhausen is the parliament of the Canton of Schaffhausen . It meets in the canton council chamber in the town hall of Schaffhausen and is the canton's legislative and supreme supervisory authority. Its 60 members are distributed over six constituencies and are elected for four years according to the proportional procedure , whereby the biproportional seat allocation procedure according to Pukelsheim has been used since 2008 . The Cantonal Council enacts all fundamental and important provisions in the form of laws. It usually holds fifteen full-day or half-day meetings per year. The current term of office runs from January 1, 2013 to December 31, 2016. The last full renewal election took place on September 23, 2012.

Basic requirements for the Cantonal Council can be found in the Schaffhausen Cantonal Constitution in Articles 52 ff.

The 60 members of the Cantonal Council are elected for a term of four years. The council exercises supreme power, subject to the rights of the people. It passes laws and oversees the canton's state organs, i.e. the government council, courts and other authorities. If it does not fall within the competence of the government council, the canton council approves or terminates international and intercantonal agreements.

Budget drafts and statements by the government council are approved or rejected by the canton council. The government council can decide independently on new one-off expenses of up to CHF 100,000 or new recurring expenses of up to CHF 20,000. Any expenditure that goes beyond this must be approved by the Cantonal Council. A referendum must be held for one-off new expenses of over 3 million francs or new annual recurring expenses of over 500,000 francs (mandatory financial referendum). A referendum can be forced by the people against new expenditures of more than CHF 1 million or a recurring type of more than CHF 100,000 if 1,000 people entitled to vote request a referendum within 90 days of the publication of the resolution (optional financial referendum).

A legislative resolution is subject to a referendum unless at least 4/5 of the members of the cantonal council present have given their consent (mandatory referendum). However, if this requirement has been achieved, an optional referendum analogous to the optional financial referendum is possible.

However, Article 34 of the cantonal constitution authorizes the cantonal council to put urgent legislative resolutions into effect immediately if two thirds of the members present agree. If such an urgency law is subject to a mandatory referendum, it will expire after one year if the people have not approved it by then.

After a new election by the Cantonal Council, the election of the office members takes place during the constituent meeting. The President of the Government Council is also elected there.

According to the rules of procedure, the office of the Cantonal Council initially consists of the President and two deputies; As a rule, they are elected in December for the year of office beginning the following January and can no longer be elected for the same offices in the following year. The council office also has two tellers and substitute tellers, as well as the council secretary. These functions are elected at the beginning of the legislative term for a period of four years and are not subject to any term restrictions.

Constitutional and legal provisions have to be discussed twice before they can be adopted. The second consultation can usually take place in the next meeting at the earliest; however, a two-thirds majority can decide to carry out the second consultation immediately. However, a third consultation can also be scheduled by a two-thirds majority.

Voting is done by not raising hands, but standing up; there is no electronic voting as in other parliaments. In the event of an obvious result, a count is waived unless a council member requests a count. In the case of final votes, however, counting is mandatory. In the event of a tie, the Presidium has the casting vote.

Article 42 of the cantonal constitution stipulates that members of the government council and the judiciary cannot be members of the cantonal council. Members of the cantonal administration who report directly to the government council or one of its members are also not allowed to sit on the cantonal council.

Number and distribution among the constituencies

By decree of November 24, 2003, the canton of Schaffhausen was divided into six constituencies. According to the results of the 2010 census, the 60 representatives are distributed as follows.

compensation

Claims for compensation and attendance fees are set out in the rules of procedure of the Cantonal Council. The amount of an attendance fee will, however, be determined by resolution during the constituent meeting, the last time on January 19, 2009, and is CHF 180.

Every council member is entitled to an attendance fee for attending a meeting. Council members who were present for less than half the session receive half the attendance fee. (Attendance is recorded twice at all meetings.) Presidents of the cantonal council and commissions receive double the attendance fee. In addition, the Presidium of the Cantonal Council receives a one-time annual lump-sum compensation for representation obligations. The parliamentary groups also receive a parliamentary group fee of six attendance fees per member.

  • Daniel Preisig had submitted his resignation from the Cantonal Council on August 20, 2013. His successor Mariano Fioretti was sworn in on August 26, 2013.
  • Christian Ritzmann resigned on September 30, 2013. Barbara Hermann-Scheck was sworn in as her successor on October 28, 2013.
  • On December 9, 2013, the resignations of Felix Tenger, Peter Käppler and Peter Gloor were announced on December 31, 2013. The obligation of their successors - Renzo Loiudice, Hedy Mannhart and Kurt Zubler - took place on January 13, 2014.
  • Erich Gysel announced his resignation at the end of June 2014. His successor is Virginia Stoll from Wilchingen; it became mandatory on August 18, 2014.
  • At the end of December 2014, Florian Keller resigned as a cantonal councilor. Linda De Ventura was her successor.
  • Christian Di Ronco also resigned from his position at the end of December 2014. The obligation of his successor Marco Rutz will take place on March 16, 2015.
