District Administrator (Glarus)

The Glarus District Administrator is the cantonal parliament of the Canton of Glarus .

By 2010 it had 80 members; this number was reduced to 60 on the occasion of the Glarus community reform with the last general renewal election. The district administrators are each elected for four years in three constituencies, which correspond to the political communities of the canton of Glarus. The last new elections took place on June 10, 2018. There were minor changes in the distribution of mandates among the three constituencies due to changes in the number of residents. There were 26 members from Glarus North , 19 from Glarus and 15 from Glarus South .

The district administrator usually meets twelve times a year, one to three times a day.

tasks

The regular term of office of the 60 members is four years, the year of office begins with the constituent meeting of the district administrator. The Glarus District Administrator is basically the canton's highest supervisory authority over government, courts and administration. In terms of legislation, the district administrator's tasks are primarily of a preparatory nature; Bills and constitutional amendments can only be worked out in cooperation with the government council ; The Landsgemeinde , which is the highest legislative body in the canton of Glarus, decides on their final adoption . Approvals to concordats and other state treaties can only be prepared by the district administrator, but ultimately also require the approval of the rural community.

The legislative proposals are published as motions in the so-called Memorial of the Landsgemeinde. However, not every single change in the law is voted on by “reducing and increasing”. Article 66 of the cantonal constitution stipulates that applications by the district administrator are deemed to have been adopted if no amendments are made. It is a regulation analogous to the optional referendum law in other Swiss cantons. Exceptions to this are, of course, drafts that must be voted on, analogous to the mandatory referendum of other cantons.

Without the consent of the Landsgemeinde, the district administrator may decide on one-off expenditure items of up to one million francs or recurring items of up to 200,000 francs. The purchase of real estate as an investment or provision up to a value of 5 million francs is also not subject to the mandatory approval of the Landsgemeinde. Ordinances, administrative and financial decisions may be passed by the district administrator, provided that this is based on authorizations in the relevant laws or in the constitution or has been decided on by the rural community.

The district administrator elects the members of the district administration office from among its members. They are the district council president, the vice president and the tellers. Furthermore, the district administrator elects the public prosecutors and youth attorneys and - insofar as the law provides - also members of the authorities and cantonal employees.

In 1971, the rural community in the canton gave women political rights. In 1972, Christine Schmidlin-Meier was the first District Administrator in Glarus to speak to the Landsgemeinde im Ring for the first time a year later .

Members

eligibility

In contrast to all other cantons, in Glarus the right to vote applies from the age of 16, provided that you have Swiss citizenship. The passive right to vote, however, remains at 18 years of age. (Article 57 of the cantonal constitution). Article 74 of the constitution also provides for the option of persons not entitled to vote being elected to certain authorities; this requires a law or an ordinance of the district administrator. Due to the separation of powers, members of the government council, court members and cantonal employees are not allowed to become members of the district administrator. The constitution also includes an exclusion of relatives for authorities; parents and children, siblings, spouses, registered partners, grandparents, grandchildren, brothers-in-law and parents-in-law may not belong to the same authority. However, this exception does not apply to the district administrator.

Number and distribution among the constituencies

The district administrator has 60 members who are distributed across the three constituencies according to the current population. The constituencies correspond to the political communities, the number of which was reduced from 25 to three at the beginning of 2011. The government council is responsible for determining and publishing how many seats are in which constituency. The “Law on Elections and Voting at the Ballot Box” sets the election date on the federal voting day in the second quarter of the year.

compensation

The remuneration of parliamentarians is regulated in the “Ordinance on the remuneration of the members of the authorities as well as the state and teaching staff”, which is also known as the “Wage Ordinance” for short. The council members receive an attendance fee of CHF 150 for each meeting of the district administrator, the office and the commissions; the presidia of the district administrator and commissions receive double the attendance fee. For the year in office, the district administration's presidency is entitled to compensation of 5 percent of the maximum wage in wage band 16, which corresponds to CHF 8838.-; the presidia of the standing commissions in the district administration receive an annual compensation of 3 percent, i.e. CHF 5303.-
