The Glarus community reform is understood to mean a radical simplification of the community system in the canton of Glarus . On the basis of the resolution of the Landsgemeinde of May 7, 2006, on the one hand the 25 local communities (as of July 1, 2006) were reduced to 3 communities (2011) and on the other hand the special types of school community , welfare community and Tagwen ( civil community ) were abolished or theirs Tasks assigned to the three newly formed communities . In addition to these unified congregations, only the parishes of the Reformed and Catholic regional churches , which are also recognized under public law, have existed since then .

The canton has been causing a sensation across Switzerland for a long time due to an emigrating population, numerous empty factories and serious financial problems in individual communities. For example, the municipality of Bilten suffered massive tax losses despite its excellent business location. This led to considerations to merge the politically independent communities into larger units. Opponents and supporters of the community reform reported to the local community with letters to the editor in the local press.

Landsgemeinde

A model was favored by the district administrator and the government council that provided for the reduction from 27 local communities at that time to 10 unitary communities. A move by Kurt Reifler even called for a reduction to three unified communities. Surprisingly, this proposal was approved by the Landsgemeinde on May 7, 2006 with a narrow majority.

Judicial and political aftermath

Shortly after the vote, voices were raised calling for the decision to be reversed because the procedure was judged to be questionable from a democratic and political point of view. The accepted but most radical form of reform - the creation of only three unified congregations - was not listed in the Memorial for the Landsgemeinde. A citizen filed a lawsuit against this decision of the Landsgemeinde at the administrative court of the Canton of Glarus. He questioned the legality of the vote, as the motion to create three municipalities was only introduced during the debate. The administrative court dismissed the action on June 6, 2006.

This lawsuit and a constitutional complaint were referred to the Federal Supreme Court. The Federal Court dismissed on 3 November 2006, both the State Legal appeal against the decision of the Administrative Court of 6 June 2006 as also State Legal complaint against the rural community of decision of the Canton of Glarus on 7 May 2006 from. The violation of Article 118 of the Cantonal Constitution of Glarus, which provides that the voters of the affected municipalities themselves decide on the existence and amalgamation of municipalities, was not examined by the Federal Supreme Court, nor was the violations of Article 34 Paragraph 2 and Article 65 of the Federal Constitution. The Federal Supreme Court only took the position that a violation of Art. 118 KV should have been reprimanded earlier, namely at the time of the preparation of the Landsgemeinde. Whether the decision is compatible with the European Charter of Local Self-Government , which has also been ratified by Switzerland, has not yet been examined.

Extraordinary Landsgemeinde

The initiative committee for a democratic, fair and efficient Glarnerland called for the convening of an extraordinary rural community with the aim of repealing the structural reform decision to create three communities. With the 2279 valid signatures he collected and submitted, the initiative came about. The extraordinary Landsgemeinde - the first in 155 years - took place on November 25, 2007 and confirmed the resolution for the community reform with a large majority. The people of Glarus felt that a memorial motion demanding that the entire canton be brought together in one municipality was too radical and rejected it.

The new churches

As a result, the names and scope of the new communities were defined and their constitution implemented. After completing all procedures at canton and federal level, the names of the communes were published in the Federal Gazette.

The working titles were Glarus Süd , Glarus Mitte and Glarus Nord . The terms Glarus Hinterland , Glarus Mittelland , Glarus Unterland were also discussed.

On April 23, 2009, the voters of the affected communities voted on the coat of arms and decided on the future community name Glarus Süd. Schwanden and Fryberg were also discussed as possible names .

Glarus North

Glarus Nord is the name of the political community, which mainly comprises the Lint plain of the canton Glarus, the Kerenzerberg and part of the Walensee . The new municipality extends over the territory of the previously independent municipalities of Bilten , Filzbach , Mollis , Mühlehorn , Näfels , Niederurnen , Oberurnen and Obstalden and had almost 17,000 inhabitants at the time of the merger.

At the community meeting on January 14, 2009, the citizens of the previous communities determined the name Glarus Nord for the future community; as a counter-proposal, the name Linth was up for discussion, but was rejected by a majority. The assembly chose the municipal coat of arms and preferred a municipal parliament in addition to the direct democratic municipal assembly .

The municipality of Glarus includes the canton capital Glarus as well as the Klöntal and the previous municipalities of Ennenda , Netstal and Riedern . The Linth flows through the valley and is surrounded by the Glarus Alps . On December 12th, 2008 the voters decided on a common coat of arms.

Glarus, Netstal and Ennenda are served by the Rapperswil – Glarus – Linthal and Zurich – Ziegelbrücke – Schwanden railway lines. The bus network for local distribution was expanded in the 80s and 90s.
