Cantonal parliaments are the parliaments or legislatures of the cantons of the Swiss Confederation . All canton parliaments are militia parliaments .
Constitutional law
Designations
The name of the parliament is different from canton to canton:
- Grand Council (French: Grand Conseil, Italian: Gran Consiglio, Romansh: Cussegl grond ) is the name of the game in the cantons of Aargau , Appenzell Innerrhoden , Basel-Stadt , Bern , Friborg , Geneva , Graubünden , Neuchâtel , Ticino , Thurgau , Vaud and Valais . The members of the upper house are in German-speaking Switzerland with Grand Council and Councilor of titled (with the exception of the canton of Thurgau, where they deviating Canton Councilor or Cantonal be called). In French-speaking Switzerland, the title is Député (Member of Parliament).
- It is called the Cantonal Council in the cantons of Appenzell Ausserrhoden , Lucerne , Obwalden , Schaffhausen , Schwyz , Solothurn , St. Gallen , Zug and Zurich . The term came up in the 19th century; the older names were Grosser Rat (renamed Solothurn 1840, Zurich 1869, Zug 1873, Appenzell Ausserrhoden 1876, Schaffhausen 2002, St. Gallen 2003, Lucerne 2008) and District Administrator (renamed Schwyz 1833, Obwalden 1867 ).
- It is called district administrator in the cantons of Basel-Landschaft , Glarus , Nidwalden and Uri .
- Parliament (French: Parlement ) is called in the canton of Jura (since the canton was founded).
Jurisdiction
The cantonal parliaments are entrusted with the constitution and legislation of those areas that do not fall within the competence of the federal government or are not exercised by it. However, it shares this competence with the people who participate in legislation through popular initiatives, referendums and referendums . In many cantons, the parliament can also issue regulations, ordinances or decrees that are not always subject to a referendum.
In addition to legislating, its tasks include the overall supervision of the cantonal administration , government and judiciary as well as the decision-making on cantonal taxes , duties and credits , the cantonal budget and the state accounts . In most cantons, it then elects judges as the electoral body, all or only those of the higher judicial authorities depending on the canton; in some cantons they also elect the district president and his deputy.

Legislative period and electoral system
A cantonal parliament is usually elected every four years. Exceptions are the cantons of Friborg , Vaud (since 2002), Jura (since 2010) and Geneva (since 2013), in which the major councils or members of parliament are elected by the people for five years. Cantons that still had shorter legislatures in the later 20th century were Appenzell Ausserrhoden and Graubünden with three and two years respectively.
The elections take place almost everywhere according to the proportional representation system. Exceptions are the cantons of Appenzell Ausserrhoden , Appenzell Innerrhoden and Graubünden , whose cantonal parliaments are elected using the majority voting system. In Appenzell Ausserrhoden, however, the municipalities have the competence to switch to the proportional representation system, which Herisau made use of in 2000. In Uri , the majority of the municipalities vote according to the majority system, the four largest, however, according to proportional representation. In Basel-Stadt , the single constituency of Bettingen elects de facto after Majorz, but with a relative majority and without a second ballot (like single constituencies in the National Council ). The elections are secret everywhere, only the members of the "inner land" of Appenzell Outer Rhodes are the county councils with hand More determined.
Of the 23 cantons in which a proportional representation system prevails (at least in some areas), three cantons ( Ticino , Neuchâtel and Geneva ) have no constituencies , but Neuchâtel guarantees the four "electoral regions" a certain minimum number of seats. Of the other cantons, eight ( ZH , UR , SZ , NW , ZG , SH , AG and VS ) use the double-proportional allocation procedure (“Doppelter Pukelsheim”), which was first tested in Zurich in 2006 and which applies to both the “upper allocation” (canton level or Constituency level in Valais and the entirety of the proportional municipalities in Uri) as well as in the "sub-allocation" (constituency level or sub-constituency level in Valais) provides for a proportional distribution of seats. The canton of Basel-Landschaft has a similar two-stage process that is applied to regions and constituencies.
In all other cantons ( BE , LU , OW , GL , FR , SO , BS , AR , SG , TG , VD and JU ) the distribution of seats takes place exclusively at constituency level, so the total number of votes at cantonal level does not play a direct role. This also applies to the major cantons and the cantons with two-stage procedures, which however do not apply the upper allocation at canton level ( VS , UR , BL ). In order to ensure a proportional distribution of seats in smaller proportional constituencies (where ten percent of the votes are not enough for one seat) ( to lower the natural threshold clause ), as required by the rulings of the Federal Supreme Court , in the cantons of Lucerne and Friborg smaller constituencies are to be « Constituency associations "amalgamated, at the level of which an" upper allocation "occurs. With the exception of the cantons with double proportion to Pukelsheim and the cantons of Ticino and Vaud ( Hare-Niemeyer procedure ), as well as Basel-Stadt ( Sainte-Laguë procedure ), all proportional cantons, such as the federal government, apply the Hagenbach system developed in the 19th century. Right of recall
Since the 19th century, according to the principles of the democratic movement, the cantonal parliament in several cantons can be called off prematurely by means of a popular initiative . In fact, this right is of little importance, as the ordinary legislative periods of four years are usually not excessively long. Corresponding initiatives were taken only very rarely and each time failed in the referendum.
The required signature numbers are:
- in the canton of Bern (law introduced in 1869) at least 30,000 signatures;
- in the canton of Uri (law introduced in 1888) at least 600 signatures;
- in the canton of Schaffhausen (law introduced in 1876) at least 100 signatures;
- in the canton of Solothurn (law introduced in 1869) at least 6,000 signatures;
- in the canton of Thurgau (law introduced in 1869) at least 20,000 signatures.
On the occasion of recent complete revisions of the cantonal constitutions, the right of recall was abolished in various cantons, namely in the canton of Aargau in 1980, in the canton of Basel-Landschaft in 1984 and in the canton of Lucerne in 2008.
