Andreas Auer

Andreas Auer (born February 29, 1948 in Chur ; † December 7, 2018 in Geneva ) was a Swiss constitutional lawyer and professor at the Universities of Zurich and Geneva .

Career

Auer studied law at the University of Neuchâtel / Neuchâtel (lic.iur. 1971 and Dr. iur. 1975 with Jean-François Aubert ) and Southern Methodist University in Dallas , Texas (LL.M. 1973). From 1980 to 2008 he was Professor of Constitutional Law at the University of Geneva , and from 2000 to 2003 he was Dean of its Faculty of Law. From 2008 to 2013 he was professor for public law at the University of Zurich . He also taught in Paris , Rome , Berlin , Antananarivo , Bamako , Dakar , Ouagadougou , Berkeley , Ulaanbaatar . His research focused on constitutional law (federal, cantons, municipalities), comparative constitutional law, direct democracy, administrative law, public procedural law, transnational law, migration law and transport law.

He was (co-) founder and former director of:

  • 1993 Center for Research on Direct Democracy in Geneva ( c2d , in Aarau since 2007 )
  • 2001 Center universitaire de droit international humanitaire in Geneva / University Center for International Humanitarian Law (CUDIH), since 2008 Geneva Academy of International Humanitarian Law and Human Rights (Geneva Academy)
  • 2009 Center for Democracy Aarau / Center for Democracy Aarau / Center for Democracy Studies Aarau (ZDA)

From 2007 he was an editorial member of the European Constitutional Law Review ( EuConst ) in The Hague / Asser , from 1980 of the current legal practice, Pratique juridique actuelle (AJP / PJA) in St. Gallen.

In addition to his academic work, he was also active as a consultant. a. from 1998 to 2012 for a law firm in Geneva, from his retirement in 2013 he was a consultant at a law firm in Zurich.

His assessment that the new equality article in the federal constitution should be weighted more heavily than cantonal autonomy inspired Theresia Rohner , a citizen of Appenzell Innerrhoden, to sue for the lack of cantonal women's right to vote. In 1990, the Federal Supreme Court gave her and other co-plaintiffs rights in a “controversial” decision , thereby introducing women's right to vote in the last canton.

Auer was involved in discussions about the development of democracy in the EU, Europe and the world. Among other things, he was a co-initiator of the democracy conferences and meetings between Baden-Württemberg and Aargau . Auer was a member of the board of trustees of Mehr Demokratie . He also worked as a co-author of the “ Rasa Initiative ” (“Get out of the impasse!”), With which the SVP's “ mass immigration initiative ” should have been reversed.

Nature conservation was also a concern of Auer. He fought at the forefront for compliance with the Water Protection Act and made a decisive contribution to preserving the Greina plateau and over a dozen other river landscapes. Auer served for many years as a board member of the Swiss Greina Foundation for the preservation of alpine rivers.

Awards

In 2003 he received the Great Walther Hug Prize as a professor at the University of Geneva in recognition of his work on Swiss constitutional law.
