Kay Nehm (born May 4, 1941 in Flensburg ) is a German lawyer . As the successor of Alexander von Stahl , he was Attorney General of the Federal Republic of Germany from February 7, 1994 to May 31, 2006 .

Life

His father Eduard participants was from 1961 to 1973 Attorney General of the State of Schleswig-Holstein . Prosecutor

In 1980, Nehm returned to the federal prosecutor's office and was initially promoted to senior public prosecutor. He was promoted to federal prosecutor in 1988. From 1991 he was a judge of the 4th criminal division of the Federal Court of Justice . Three years later he was appointed general public prosecutor and thus head of the federal prosecutor's office.

In 2003, Nehm conducted an investigation into the Sahara hostage situation .

In his office he represented sometimes controversial, legally stringent decisions. For example, in the prosecution of terrorist offenses, he required US services to fully disclose their sources and evidence to his authorities. Only then is evidence to be used to the detriment of the accused, which the case law has confirmed.

Nehm retired on May 31, 2006. His successor was Monika Harms .

Kay Nehm became President of the German Academy for Transport Science. The Association against Alcohol and Drugs in Road Traffic awarded him the Senator Lothar Danner Medal in 1998 .

Since 2010 he has been President of the German Traffic Court Conference . At the German Traffic Court Conference in 2010, Kay Nehm proposed a new category of law - the memorandum . In the future, vehicle owners should be confronted with this if the electronic monitoring systems fail in the event of a traffic violation and the vehicle driver cannot be identified. Nehm also called for stricter controls for alleged " rowdy cyclists " during the traffic court day in 2013 , which is why Die Zeit accused , among others, of a "populist rowdy cyclist attack".

criticism

His suitability as President of the German Traffic Court was questioned because he unilaterally positioned himself as a proponent of automobile traffic and polemicized against cyclists. He claimed that hardly any cyclist adhered to the traffic rules, but could only base this on "personal statistics" and also suppressed the fact that motor vehicle drivers are mainly responsible for around 60 percent of accidents involving bicycles with cars. In the opinion of his critics, he does not meet the necessary impartiality for the office of President of the Transport Court.

The UN special rapporteur Leandro Despouy raised the charge of political influence on the German judiciary in 2007, after both Kay Nehm, in the role of Federal Prosecutor in February 2005 and Nehm's successor Monika Harms in April 2007, rejected the former US Defense Minister Donald Rumsfeld and 13 other high-ranking political and military figures for violations of international law and the UN Convention against Torture . Both criminal complaints were filed by the Berlin specialist lawyer for criminal law Wolfgang Kaleck , who cited the international criminal code that has been in force in Germany since 2002 .
