Kristina Gisela Hänel (born August 5, 1956 ) is a German specialist in general medicine and emergency medicine . The doctor, who practiced in Giessen , gained national notoriety because she was charged with advertising for the termination of pregnancy ( Section 219a of the Criminal Code ) and sentenced to a fine. In an appeal filed by Hänel, the Frankfurt Higher Regional Court (Az .: 1 Ss 15/19) overturned the conviction in July 2019 and referred the matter back to the Giessen Regional Court , which opened the case in view of the amendment to § 219a of the Criminal Code had to negotiate again. The Giessen Regional Court thereupon sentenced Hänel again in December 2019 to a fine of 25 daily rates. Hänel announced an appeal against the judgment.

Live and act

Hänel comes from a family of doctors. After graduating from high school at the age of 18, she began studying medicine. Hänel has been working as a licensed doctor and emergency doctor in the rescue service since 1981, and has completed further training in emergency medicine, anesthesia and sex therapy . Her first employment after graduation was at Pro Familia centers and in Stimezo clinics in the Netherlands. She has had her own practice in Giessen since 2001. Her main areas of expertise, in which she works and advises medically, include topics such as women's health, sexuality, family planning , pregnancy , childbirth and abortion .

Hänel was a founding member of Wildwasser Gießen, an association against the sexual abuse of girls and women. At the Justus Liebig University in Giessen she had a teaching position on sexual trauma in childhood. She volunteers in the working group Women's Health in Medicine, Psychotherapy and Society eV, at Pro Familia eV, in the German Society for Sexual Research . She also offers therapeutic riding for traumatized children and adolescents in integrative groups.

Hänel was married and gave birth to their now grown-up children while studying. She is a marathon runner and competes internationally for the age group national team of the German Triathlon Union .

Legal disputes

Criminal proceedings

Since 2009, three preliminary investigations have been pending against Hänel on suspicion of advertising for the termination of the pregnancy . As a result of the third preliminary investigation, Hänel was sentenced to a fine of 40 daily rates by the Giessen District Court on November 24, 2017 , because she had declared on the website of her practice that she would perform abortions. In October 2018, the district court of Giessen rejected Hänel's appeal against this conviction . Hänel appealed against revision one. The reports that led to the preliminary investigation were submitted by Yannic Hendricks , among others .

The judgment of the regional court of Giessen against Hänel for "advertising abortions" was overturned, announced the higher regional court in Frankfurt am Main on July 3, 2019. Section 219a, which has been amended since March 2019, is to be applied in their favor. The Giessen Regional Court thereupon sentenced Hänel again in December 2019 to a fine of 25 daily rates. The judge combined her verdict with criticism of the legislature: "It makes no sense to criminally prohibit factual information about a medical intervention" and "It is difficult to find arguments that the 219a has come into law in this way." Hänel resigned Appeal against the judgment.

The legal dispute sparked public criticism and a debate about the abolition or reform of Section 219a of the Criminal Code. Bündnis 90 / Die Grünen , Die Linke and the FDP campaigned for the abolition or restriction of the criminal offense. After a 45-minute reading and debate in February 2018, the topic was handed over to the responsible committee for legal and consumer protection for further processing. In June 2018, a hearing took place in front of the committee with strong public and media sympathy, in which nine experts presented their position and the three existing bills of Bündnis 90 / Die Grünen, Die Linke and FDP were discussed. In December 2018, the Ministries of Justice, Women and Health agreed on a legal compromise for Section 219a of the Criminal Code, which was passed by the Bundestag on February 21, 2019 in a roll-call vote with a majority of the CDU, CSU and SPD and on March 29 came into force. Hänel criticized this reform as tightening the penal code. It blocks the way for a liberal interpretation of the norm, as it was previously possible.

Civil proceedings

In taz , Junge Welt , Neues Deutschland and on Deutschlandfunk , Hänel commented on the legal and political issues surrounding the conflict. After the anti-abortion opponent Klaus Günter Annen had compared her with perpetrators of the Holocaust and described her as “degenerate”, she successfully defended herself against it in August 2020 with an injunction before the court. Annen also had to pay her compensation of 6,000 euros.
