List of judicial districts in Silesia

This list of judicial districts in (Austrian) Silesia lists all former judicial districts in the Crown Land or Duchy of Upper and Lower Silesia as well as Moravian enclaves that are subject to the Silesian regional and district courts.

The judicial districts of Austrian Silesia go back to the year 1849, when the basic features of a new judicial system for the Habsburg Empire were approved by Emperor Franz Joseph I. Justice Minister Anton von Schmerling subsequently outlined a reorganization of the judiciary in Silesia, which was approved on June 17, 1850 with an "Imperial Decree". At the same time, Emperor Franz Joseph I instructed the Minister of Justice to carry out this reorganization. The abolition of the previous patrimonial and municipal courts in Silesia made it necessary to reorganize the judicial districts, with Schmerling providing for the creation of 100 district courts in Moravia and Silesia in his plans, all of which were to be subordinate to the Higher Regional Court of Brno .

For Silesia itself, Schmerling provided for two regional and district courts in Teschen and Troppau with 14 and 8 district courts, respectively. The Higher Regional Court of Brno subsequently took up its office on May 1, 1850, with Emperor Franz Joseph not forwarding the principles of the judicial and administrative organization for the Habsburg Empire to Prime Minister Schwarzenberg for implementation until December 31, 1851.

In April 1854, the ministers of the interior, justice and finance finally laid down the final court and administrative division in an ordinance, whereby, as already outlined in 1849, 22 court districts were created, which were subordinate to the regional court of Teschen and the district court of Troppau.

The division of the judicial districts hardly changed until the end of the Habsburg monarchy. In 1869, the new judicial district Würbenthal was created from parts of the judicial districts Freudenthal, Zuckmantel and Jägerndorf . From parts of the judicial district of Hotzenplotz , the judicial district of Hennersdorf was also established in 1873 , and in 1904 the judicial district of Polish Ostrava was formed from parts of the Oderberg judicial district .

In addition to parts of the actual Crown Land of Silesia, the Opava District Court also subordinated the enclaves of the Crown Land of Moravia in Silesia. these were the judicial districts of Hotzenplotz and Hennersdorf or parts of the judicial districts of Troppau and Wagstadt. In political terms, however, the Moravian enclaves were most recently assigned to the Moravian constituency No. 14 (German) .
