Meinhard Lukas

Meinhard Lukas (born February 20, 1970 in Wels ) is professor of civil law at the Faculty of Law at the Johannes Kepler University Linz and has been the rector of this university since October 2015.

Origin and education

Meinhard Lukas was born in Wels as the son of the judge Julius Lukas and the vocational school teacher Helga Lukas. He attended the modern language grammar school in Wels, Dr. Schauer Straße and then began studying law at the Johannes Kepler University in Linz and business administration at the Vienna University of Economics and Business . After completing his law studies in 1992, he received his doctorate in 1998. iur.

Professional career

Lukas began his academic career in 1990 as a study assistant at the Institute for Civil Law at the University of Linz and published his first work in the legal journals before completing his degree. After working as a university assistant to Rudolf Reischauer and Peter Rummel and as a trainee lawyer in a law firm in Linz, he completed his habilitation in 2004 in civil law at the University of Linz, becoming an associate professor. After receiving a professorship from both the University of Salzburg and the University of Linz, he succeeded Karl Spielbüchler in 2008 as professor of basic research at the Institute for Civil Law in Linz and was appointed university professor. Lukas has been dean of the Law Faculty of the University of Linz since October 2011 .

Meinhard Lukas' main research areas include contract law, impairment law and damage compensation law, as well as international business law including international credit security law. Lukas has repeatedly represented Austria at the United Nations Commission on International Trade Law ( UNCITRAL ) in various working groups, was called in as an expert by the UNCITRAL Secretariat and has worked on projects at the European Center of Tort and Insurance Law and the Max Planck Institute for Foreign and International Affairs Participated in private law in Hamburg. Since 2009 he has been a member of the board of directors of the Peter Rummel Study Fund for the promotion of talented students in the field of civil law at the University of Linz. He is also a member of the Institute for Banking Law at the University of Linz and President of the Graduate Association of the BG / BRG Dr. Schauer street in Wels.

Meinhard Lukas also works as a legal expert and arbitrator and occasionally comments on current legal cases. In April 2007, Martin Karollus and Meinhard Lukas, on behalf of Eurofighter Jagdflugzeug GmbH , prepared a legal opinion on the permissibility of a termination of the contract for 18 Eurofighter fighter aircraft by the Republic of Austria and denied a right to termination. Ultimately, Defense Minister Norbert Darabos refrained from terminating the contract on the basis of the report prepared by Helmut Koziol for the Ministry of Defense and compared himself with Eurofighter. Meinhard Lukas acted as legal expert for the state capital Linz in a legal dispute with BAWAG PSK . It involved a swap deal that could damage the city by more than € 400 million. On June 28, 2013, however, Lukas resigned his honorary position as advisor to the city of Linz in this legal dispute, as the responsible politicians were "resistant to advice". In February 2013 he was entrusted with dealing with the Salzburg speculation scandal. At the beginning of April he presented an expert opinion commissioned by the investigative committee of the Salzburg state parliament on the dissolution of around 250 derivatives in the last quarter of 2012. At the same time, he checks claims against the banks involved on behalf of the State of Salzburg.

On February 9, 2015, he was elected Rector of the Johannes Kepler University Linz by the University Council for the period from October 1, 2015 to September 30, 2019. He is also a member of the scientific advisory board of the Upper Austrian think tank ACADEMIA SUPERIOR - Society for Future Research .
