One People's Public Trust

The One People's Public Trust (OPPT) is a movement whose supporters question the legitimacy of all nation- states as part of a conspiracy theory . The group's supporters believe that states are just companies. The ideological argumentation of the OPPT is similar to that of the Reich Citizens Movement in Germany .

The group sees itself as legitimized for the whole world, but has so far mainly acted in the United States of America . However, the group is increasingly gaining support from supporters in German-speaking countries. In Europe, these have so far mainly appeared in Austria . In their opinion, the Republic of Austria was dissolved due to the failure to object to an alleged foreclosure ("UCC financial statement").

history

Allegedly, the three US lawyers Caleb P. Skinner, Heather A. Tucci-Jarraf and Hollis R. Hillner founded this organization in 2012. The founders came from the Freemen on the Land group , an anarchist movement that rejects and fights state structures. On December 25, 2012, they announced that the property had been seized from all governments and banks in the world and promised each of their followers $ 10 billion in gold and silver.

Since the beginning of December 2012, the operators of the OPPT had alleged seizure claims against individual states and banks registered in several US states. This was made possible by the American system of debtor registers, which are kept in each of the US states, whereby one can register alleged claims without checking simply by filling out a form, the "UCC financial statement". Thus, in the event of a claim, priority is ensured for the satisfaction of the claim in favor of the person who previously initiated such an entry in the register. Although the register entry per se cannot result in an actual claim, the representatives of the OPPT pretend to their supporters that the register entries prove immense claims against states, banks and individuals in the billions . Because the claims registrations via UCC were not taken seriously by anyone and therefore nobody reacted or replied to them, according to the presentation of the OPPT on December 25, 2012, all of their claims should have come into force through "silent consent". With the subsequent dissolution of the trust in 2013, “the last remnant of the old system was officially disposed of,” including the Republic of Austria. As a result, all legal entities were formally dissolved irrevocably.

The OPPT activists claim that contracts are also made through "silent consent"; This means that a party's declaration of intent would be deemed to have been made if the party did not respond to a letter. However, silence in legal transactions does not constitute a declaration of intent. The only exception here are certain very special constellations in commercial law . Under certain conditions, a merchant must immediately object if he does not want the content of a letter of confirmation sent to him to apply. However, this regulation from Section 362 of the German Commercial Code only applies to merchants and also only in a few very specific constellations: If a merchant whose business involves doing business for others receives an application for the handling of such business from someone he is with is in a business relationship, he is obliged to answer immediately; his silence counts as acceptance of the application. Because within a commercial business relationship, the merchant traditionally has special duties.

German OPPT activists, like many citizens of the Reich, counterfactually spread the claim that this exemption from commercial law is generally valid, i.e. for declarations of intent by any natural or legal person, and that in this way entire states could be dissolved and seized if they are not contradict. This is exactly what happened in 2012 at the latest.

Activities in the Anglo-Saxon area

The idea of ​​the OPPT quickly spread throughout the Anglo-Saxon region . In July 2013 , on the advice of OPPT, New Zealander Kiri Campbell attempted to have $ 15 million of her alleged balance in the OPPT Trust credited to her account and wrote bad checks for $ 60,000. She was arrested and admitted to wrongdoing, which is why she was sentenced to 200 hours of community service. Nevertheless, she was hailed as a heroine among supporters of the OPPT.

Activities in Austria

In July 2014, Austrian OPPT supporters from the municipality of Waidhofen an der Thaya had a “UCC financial statement” entered in the debtor register of the US state Washington with alleged claims against unpopular authorities and police officers.

In summer 2014, a so-called “People's Tribunal” of an alleged “International Common Law Court of Justice, Vienna” (ICCJV) was held against a local lawyer on a farm operated by OPPT supporters in Waidhofen (district of Hollenbach). Around 40 activists were present. The lawyer was employed as the trustee of an OPPT member who was indebted and had been admitted to psychiatric treatment. Before that, OPPT “sheriffs” had already appeared at the lawyer's home to “summon” her. A video recorded by OPPT activists also shows how some activists at the local police station presented arrest warrants against the lawyer that they had written themselves and tried to support this with ID cards made by themselves “from Brussels”.

After a police raid, the public prosecutor's office in Krems an der Donau investigated the responsible OPPT members. Since then, the OPPT scene has also been under observation by the Austrian Office for the Protection of the Constitution. The movement is classified as a sect by the authorities . Their leader, who calls himself "Sovereign (Terrance) O'Connor," is a US citizen . He was in custody for two months after the raid. After his release, he applied for political asylum in Austria . Ultimately, however, he was deported from Austria to the USA .

One supporter of the OPPT concept is Franz Hörmann , associate professor at the Vienna University of Economics and Business . Hörmann presented the OPPT concept, among other things, in May 2013 in an Okitalk - an Internet platform where relevant lectures and discussions on the topic are streamed. In his lectures and discussions, Hörmann likes to talk about conspiracy theories, extraterrestrials or the possible future gold production from mercury.

Among other things, in response to the activities of the OPPT in Austria, the creation of a new criminal offense against subversive movements (Section 247a StGB ) was decided in June 2017 , which, under certain conditions, enables the establishment, leading activity in, participation in or support of such a movement with up to Threatened to two years imprisonment. The OPPT was explicitly cited as an example in the government bill.

Fantasy Court ICCJV

OPPT activists founded the “International Common Law Court of Justice” (ICCJV) based in Vienna on June 19, 2014. The court based on natural law, international law and generally applicable jurisprudence . The foundation would be based on the signing of the “International Common Law Charter”, the “International Law Founding Treaty” and the “Vienna Statute of the International Common Law Court of Justice”. The establishment of this "court" had been announced to the UN and the International Court of Justice in The Hague and recognized by them. The staff of the "International Common Law Court of Justice" would enjoy diplomatic immunity . The ICCJV activists are trying to establish parallel justice to the existing ordinary jurisdictions of the individual nation states in German-speaking countries. The ICCJV activists justify the alleged recognition of the ICCJV by the UN and the International Court of Justice in The Hague with the fact that the ICCJV had not been contradicted in writing within one month. The ICCJV is seen by official bodies as a fantasy court or pseudo-court run by a handful of state objectors.

The domain name of the ICCJV's website was registered in July 2014 by Marcus Steiner, at that time a member of the board of the BZÖ party in Vienna. In the 2013 National Council election, Steiner ran on the BZÖ state list for Carinthia . Wolfgang Empacher is also active in OPPT and ICCJV, who was a candidate in the 2013 National Council election on the BZÖ's Vienna State List. Steiner and Empacher were expelled from the BZÖ party after their OPPT and ICCJV activities became known.

On July 14, 2014, the ICCJV issued an “arrest warrant” against the ÖVP politician Erwin Pröll and eight other Austrian governors for “crimes against humanity and slavery”. The arrest warrants were signed by Wolfgang Empacher.

In a kind of job advertisement, the ICCJV has been looking for “sheriffs” on Facebook since November 2014 in order to arrest convicted judges and politicians. It says there: "We are looking for men and women with experience in martial arts, personal protection, military and police matters". The ICCJV has put its own manual on its website. It describes the alleged organizational structure of the “Court of Justice” with juries, justices of the peace, prosecutors, clerks, court administrators, bailiffs (“sheriffs”) and deputies. It says there, among other things, "The sheriffs serve as a protective and executive body to the Court of Justice" and "ID cards and brands are to be applied for and provided via the Court of Justice". With regard to the tasks and duties of the allegedly ICCJV own bailiffs, there is u. a. the "enforcement of enforcements, decisions and judgments", "guarding and evacuation of convicted persons" and "carrying out arrests with submission of the signed decision or judgment of the ICCJV" are listed. The ICCJV bailiffs allegedly have the right to “carry weapons for self-defense or to frustrate and prevent criminal offenses” and “to oblige local authorities to cooperate in investigative measures”. In addition, the ICCJV movement has published a bizarre “Vienna Statute” on its website, which is apparently intended to represent a kind of constitution or basic law for the activities and legitimation of the ICCJV.

In January 2015 the ICCJV announced that it wanted to move into two to three rooms in each of the Austrian regional courts for its negotiations according to “natural law”. In the opinion of the ICCJV movement, this would make it possible for anyone close to the location to officially file a lawsuit in an “ICCJV court”. The Federal Ministry of Justice had issued a warning to the regional courts about this announcement of the occupation. However, nothing is known of any occupations actually attempted by ICCJV sympathizers.

On May 25, 2016, the association "IIA - International Intelligence Agency" with its headquarters in Müllheim , Hofstrasse 1, was entered in the commercial register of the Swiss canton of Thurgau . The association's purpose is the training, coordination of cooperation, provision of equipment, representation of interests of the members of the association towards the courts of the ICCJV. The Austrian Marcus Steiner was registered as the club's president and the Austrian Wolfgang Empacher as the first vice-president. The address in Müllheim is the so-called "Modelhof", which is also mentioned in the imprint on the ICCJV website as the address of the "Court of Justice". The Modelhof is owned by Daniel Model, a Swiss entrepreneur ( Model Holding ) who has appeared as a critic of the state several times. In 2006 Model had proclaimed its own state called " Avalon ".

According to its own description, the "International Intelligence Agency" association is responsible for intelligence investigations and information gathering. Cooperation with other international intelligence services is an option. Other associations have been registered at the address of the Modelhof, all of which work for the ICCJV court: "International Sheriff Association", "International Right Commission" and the "International Right Organization". For example, their sheriffs are supposed to arrest the people who have been convicted by the ICCJV court.

On March 14, 2017, the criminal process began before the regional court in Krems an der Donau because of the incident on the farm in Waidhofen-Hollenbach in the summer of 2014. The public prosecutor accused the eight defendants of severe coercion, persistent persecution and presumption of office. On April 13, 2017, the Krems Regional Court sentenced six of the defendants to prison terms of up to 20 months (of which 15 months conditional ). The activist Marcus Steiner was sentenced to 18 months (14 months conditional).
