Peter Joseph Floret

Peter Joseph Floret (born January 18, 1778 in Werl ; † September 3, 1836 in Darmstadt ) was a lawyer, initially in the Cologne-Electorate and later in Hessen-Darmstadt services. He published numerous statistical, constitutional and legal publications and was a member of the Legislative Commission, the State Parliament and the State Council of the Grand Duchy of Hesse.

He came from a legal family in Werl and was the son of Caspar Anton Johann Floret. The father was a court councilor from Cologne, a city judge in Werl and later a grand ducal Hessian judicial officer in Werl. The mother was Maria Barbara Felicitas Adolfina, née Arndts. Peter Floret's brother Engelbert Joseph Floret emerged from the parents' marriage. His daughter Adolphine Barbara Engelbertine Caroline Eleonore Zais nee Floret (* August 1806 in Gießen; † January 15, 1876 in Wiesbaden) married the hotelier and liberal MP Wilhelm Zais .

Life

He studied law in Münster and Göttingen . After completing his studies, he returned to the Duchy of Westphalia and initially became a lawyer. In 1801 he joined the Kurkölner Officilatgericht (which soon after became the Court Court Arnsberg ) as an assessor , which was located in the Westphalian part of Kurköln after the French occupation. In 1802 he became a chancellery in Arnsberg. In 1804 he was appointed court judge . On August 28, 1804, he married his cousin Anna Elisabeth Therese Beatrix nee Arndt (1775–1836) in Arnsberg .

After the transition of the Duchy of Westphalia to Hessen-Darmstadt, he entered the Hessian service and was court judge in Gießen and in 1810 appellate judge in Darmstadt . In 1827 he became a Privy Councilor .

He has participated in contemporary legal and constitutional discourse. Between 1808 and 1811 he was a co-entrepreneur of the journal for constitutional law, politics and statistics with the title Germania. In addition, he wrote numerous statistical reports on individual territories. The script assigned to him by Johann Suibert Seibertz : "Some statistical remarks about the Duchy of Westphalia," is now often ascribed to Friedrich Arndts . He also wrote numerous articles for magazines, for example for the Westfälischer Anzeiger. He also published some works anonymously.

In 1814 he spoke out in favor of the legal unity of Germany and argued "nothing alienates peoples from one another as much as the difference in laws and political institutions". He also called for the sovereignty rights of the member princes to be ceded in favor of the German Confederation .

Since 1816 he was one of three members of the legislative commission that was supposed to draft a constitution for the Grand Duchy of Hesse . According to this, the Commission should also draw up a civil code, a code of civil procedure, a criminal code and the relevant comments. Two years after the constitution was published, he submitted a comment on the matter. In 1821 he also published a historical-critical account of the negotiations of the assembly of estates of the Grand Duchy of Hesse .

In the 1st and 2nd electoral periods (1820-1824) he was himself a member of the second chamber of the state estates of the Grand Duchy of Hesse. In the state estates he represented the constituency of Upper Hesse 11 / Hungen .
