tm3 was a German-speaking private broadcaster operated by Timo C. Storost, who operated under the name ITV Media Interactive eK . In addition, a sister station was operated as an internet station, blizz or tm3 +. Both programs have been discontinued.

Tm3 was founded under the name Family TV. It is said to have been a successor channel to the former call-in profit radio station 7live , which started operating as an Internet radio station in mid-June 2008. Timo Storost, then 18-year-old managing director and main presenter of five presenters, expanded the station into Internet television with a changed program schedule and a new name in September 2008, before starting the new station as a full program with an official license from the media authorities. Despite the similarity of the organizer's name, there was no affiliation with the British ITV . In the 2015 financial year, the ITV Media Group, which stands behind Family TV, reported a profit of € 174,528.33 before interest, taxes, depreciation and amortization for the first time in its history. The total costs should have been € 930,841.07 and the gross profit € 1,105,370.57. For 2016, sales of 1.5 million euros were expected and a profit target of around 200,000 euros was set. The information turned out to be a lie in November 2017. In the decision of the VGH Munich, the court irrevocably determined that the ITV Media Group had made a loss in both 2015 and 2016. In the more than 10 year history only losses were made and never reached the profit zone. The court process in March 2019 revealed that an appraiser appointed by the court had certified the media company as insolvent since 2014. Between March 2016 and the beginning of 2017, the program was downgraded to the division program. Before the Astra connection to 19.2 °, Family TV could be received via the Hotbird satellite. Originally it was planned that the women's channel blizz, which also belongs to the ITV Media Group, should take the former Hotbird site. At short notice, however, a decision was made against it. The main station was temporarily broadcast via the multithek and, for a longer period, via other IPTV providers such as Zattoo . In September 2016, Oli.P became a brand ambassador at the station together with its title As before - the sender's claim . A little later, it was replaced by “Runs with us!”.

On June 1, 2017, the ITV Media Group wanted to start a new channel under the name “tm3” - initially only via Internet Protocol Television (IPTV) and as an HD variant; a broadcast via Astra 19.2 ° East was planned. However, the start had to be postponed. It was reported that the station was in the approval process. The official press release stated that the new channel tm3 would be a documentary and series channel for the core target group of 25–69 years, male / female. The focus should be on series from the 1990s. In the area of ​​documentaries / magazines, the station wants to concentrate on older material. In mid-2018, however, almost half of the 24-hour program consisted of teleshopping formats from third-party providers. Apart from that, Family TV only broadcast three series in a loop, enriched with travel documentaries. On January 12, 2019, the live show 10 Years of Family TV announced that the brand would be rededicated in tm3 on January 13, 2019 . It only started broadcasting on January 13, 2019 when Family TV was renamed tm3. Blizz has been renamed tm3 + and will be discontinued until March 7, 2019, with the main program on March 31, 2019.

The organizer company FBT Deutschland GmbH was responsible for tm3 + and the internet presence including social networks of both broadcasters .

Criticism of Family TV

In March 2012, there was a lawsuit between the operator of the Internet magazine and blog Fernsehkritik TV Holger Kreymeier and the operator of the television station Timo C. Storost. So Storost wanted to get an injunction against a contribution by the television critic. This project mostly failed. For example, the judge had taken the television critic's statement that the Family TV program was "garbage" as free expression. In addition, the court considered it just as likely that Storost published unrealistic viewership figures (up to an average of 900,000 viewers on the website, which was the only distribution channel at the time).

Program content

Family TV's programming consisted primarily of classic series, feature films, shows, documentaries and magazines. In 2016, the media group acquired a film package that was intended to upgrade Family TV's programming for Christmas 2016 and throughout 2017. According to the broadcaster, it included free TV premieres and more recent films. As an Internet broadcaster, Internet broadcasting was part of the purchased film rights from the very beginning, so that the entire program was streamed on the Internet without any interruptions.

The program content was initially adopted under the new name tm3, but then greatly reduced. Most recently there was only teleshopping during the day and an editorial program at 8:15 p.m.

License withdrawal proceedings

In July 2017 it became known that the Commission for Approval and Supervision (ZAK) had revoked the broadcasting license of Family TV and blizz on June 28th. The responsible State Agency for Communication (LfK) stated on July 27th that Family TV had committed “repeated copyright violations” and also several “violations of media law”. Broadcasting must therefore be stopped. This process is one-time for transmitters during operation. The operator had announced an appeal against the decision and continued broadcasting beyond the renaming in January 2019.

On March 12, 2019, the owner of the station, Timo C. Storost, was sentenced to three individual sentences by the Augsburg district court, all of which were suspended: one year and six months, ten months and one year, three years and four months in total. He was convicted of driving without a driver's license , fraud , forgery of documents and for not registering bankruptcy and, according to the judgment, has to do 200 social hours and a compensation of 194,000 euros in addition to the suspended sentence on probation . The chairman of the jury made it clear that with the probation not only "a sword of Damocles hangs over him", but "a big machete on a silk spider thread"; he was "a hair's breadth" missed a prison sentence ; The Bavarian State Center for New Media (BLM) also commented that his "unusually persistent refusal [...] to behave in accordance with the law puts the rule of law [...] to the test."

Storost then announced in the courtroom that it would cease operations of its channels at the end of March 2019 and file for bankruptcy for the company and for itself. According to his own statements, he wanted to gain some distance for health reasons. He later added in a statement that the cessation of broadcasting operations had nothing to do with the withdrawal of the license or the verdict and that it was allegedly done voluntarily.
