Walter Frenz

Walter Frenz (born March 30, 1965 in Schwäbisch Hall ) is a German law scholar and university professor .

Career

Walter Frenz passed his Abitur in 1984 and studied law at the universities of Würzburg , Caen and Munich from 1985 to 1989 . He passed his first state examination in law in 1989. From 1989 to 1992 he completed his legal traineeship in the Stuttgart Higher Regional Court as well as in Speyer and Heidelberg. During this time he was at the University of Munich in 1991 with the dissertation The state liability in the mortgage lending facts to Dr. iur. doctorate and laid a year later on his second state exam. From 1994 to 1996 he was a research assistant at the University of Münster and from 1994 to 1997 professor for German law ( public law ) at the University of Nijmegen . In 1997 he followed a call to RWTH Aachen . There he heads the teaching and research area for mining , environmental and European law . The teaching and research area is organized within the Faculty of Georesources and Materials Technology and is part of the specialist group for raw materials and disposal technology. In addition to courses on general environmental law, European law and public law, students from various engineering sciences also attend lectures on raw materials and energy law as well as events on licensing issues. Alexander Schink and Hans-Jürgen Müggenborg, among others, also work as lecturers in the teaching and research area. With the latter, Frenz wrote a legal textbook for budding engineers. On February 22, 2018, he received a certificate from the then rector of RWTH Aachen, Ernst Schmachtenberg, for his 25th anniversary with the company, who thanked him for his work at RWTH Aachen.

He is co-editor of the journals Wirtschaft und Verwaltung, European economic and tax law, environmental and planning law and since 2015 editor of nature and law together with Michael Kotulla. He is also a member of the editorial board of the magazine Abfallrecht . He is the author of numerous comments on current decisions, which are regularly printed in the German Administrative Gazette (DVBl) . In addition to publications in specialist magazines, he is also regularly asked about environmental and mining law issues as an expert in daily newspapers or political magazines for public broadcasters. In 2016 Frenz was the country reporter for the FIDE Congress.

Research priorities

His main research areas are energy law, public commercial law and competition law. Current articles and legal comments on these topics include, in particular, digitization and Industry 4.0, for example in relation to procurement law or the energy industry. With regard to the latter subject area, he comments on EU state aid law for the six-volume loose-leaf work on energy law published by Wolfgang Danner and Christian Theobald.

He also publishes numerous articles on intensely discussed questions, for example on the subject of species protection and wind power in the journal Natur und Recht (NuR) , fracking, the energy transition , the reform of mining law, terrorism and human dignity as well as Industry 4.0. Frenz takes a legal view of current issues such as the migration crisis or drought aid in the event of drought.

Another main area of ​​work is the numerous comments by Frenz on environmental law in various publishers. So to the EEG, WHG, BNatSchG (Erich Schmidt Verlag), emissions trading law, BBodSchG (Beck Verlag) and waste law (publishing group Hüthig Jehle Rehm). A commentary on nuclear law published by him has been announced for publication by Nomos-Verlag for October 2018. He is also the author of a six-volume manual on European law (Springer Verlag), which is now gradually appearing in a second edition. The volume on antitrust law was also published in English at the beginning of 2016 under the title Handbook of EU Competition Law (see publications). His exam book on public law was published in the 7th edition by Vahlen-Verlag and is a valued standard work on exam preparation among students.

Colloquia

Together with Axel Preuße, Frenz is the scientific director of the Aachen Colloquium on Contaminated Sites and Mining Damage (ABK) and the Colloquium on Business and Environmental Law (KBU). The colloquia are jointly organized by the teaching and research area of ​​Mining, Environmental and European Law (BUR) and the Institute for Mine Surveying, Mining Damage and Geophysics (IfM) as institutions of RWTH Aachen University and by the Society of Metallurgists and Miners (GDMB). The speakers are mostly lawyers, engineers and representatives from authorities. The GDMB publishing house always publishes a conference volume with contributions from the speakers for the colloquia. Furthermore, conference reports appear regularly in legal journals.

Plagiarism Controversy

In 2011 there was a plagiarism controversy in the teaching and research area of ​​Prof. Frenz. Around 40 pages of an employee's doctoral thesis matched an already published manual by Frenz, although it was unclear who was plagiarizing whom. The matter became known through an article in the Spiegel by Hermann Horstkotte , who continued to report on it.

At the end of June 2016, the press release “Suspected plagiarism against Prof. Frenz invalidated” was published on an official RWTH Aachen website, in which it was claimed that it was not Frenz who plagiarized, but his doctoral student. There was also to read that the University of Bonn had "carried out a review of all dissertations supervised by Prof. Frenz" and, according to the Bonn dean Rainer Hüttemann, "found no complaints regarding compliance with the rules of good scientific practice". However, Rainer Hüttemann subsequently made it clear that this was not true: by no means all of the dissertations supervised by Frenz had been checked, but only a selection and, in particular, not the dissertation in question. Thereupon the law faculty in Bonn ended the cooperation with Frenz.

It turned out that Frenz himself had launched this press release and published it on this page without the knowledge of the university. The rector of RWTH Aachen University, Ernst Schmachtenberg , then had the press release deleted. Subsequently, it became known that Frenz had tried with the falsified press release to induce various publishers to change or delete reports about him. However, these did not respond to his request.
