Claus Sprick

Claus Sprick (born June 3, 1946 in Bad Rothenfelde ) is a German lawyer and translator . From 1994 to 2009 he was a judge at the Federal Court of Justice .

Legal background

After studying law and doing a legal clerkship , Sprick joined the judiciary in the state of North Rhine-Westphalia in 1973 . During his time as a probationary judge, he worked at the Essen District Court and the Essen-Werden District Court . From 1975 to 1976 he was seconded to the North Rhine-Westphalian Ministry of Justice and worked there at the Judicial Examination Office. While working in the ministry, he was appointed judge at the regional court. He then worked at the regional court in Essen and in 1987 became presiding judge at the regional court in Essen. From 1988 to 1991 there was another secondment to the State Ministry of Justice and from 1991 to 1994, following the reunification, a secondment to the Potsdam District Court .

Claus Sprick became a judge at the Federal Court of Justice in 1994. He belonged there to the XII. Civil Senate , which deals with tenancy law and family law. He became Vice Chairman of the Senate in 2004 and retired on June 30, 2009. Sprick was instrumental in the development of the child procedural law in the highest court jurisdiction . Examples are the fundamental judgment on the uselessness of secret DNA tests in proceedings to establish paternity or on the prerequisites for restitution claims in the case of paternity findings, for post-mortem determination of paternity, for the exploitation of judicial parentage reports obtained in violation of procedural regulations , the replacement of consent in the case of adoptions and the immutability of the child's name by naming it . Sprick particularly stood out for his knowledge of international law . He was therefore the author of fundamental judgments on the demarcation between the applicability of German and foreign law, on jurisdiction in the recognition and enforcement of decisions in maintenance matters and in matters of marriage and custody according to the European Enforcement Ordinance , on the interpretation of the Hague Child Abduction Agreement or on the application of religious law foreign marriages. In tenancy law, the case law of the BGH, the case law on the written form of long-term commercial space leases and rulings on rent guarantees, the statute of limitations and the restitution of the deposit after the property has been sold go back to Claus Sprick.

Claus Sprick was consulted by the Council of Europe from 2002 to 2007 as an expert on draft laws on Moldovan civil and civil procedural law , Ukrainian commercial procedural law, the Montenegrin Code of Obligations and the Kosovo Civil Status Act . Sprick was also appointed ad hoc judge at the European Court of Human Rights .

Claus Sprick is a recognized interpreter and translator for English , French and Russian . He is a co-founder of the European College of Translators , of which he became President in 1990. He translated numerous literary works from French and English.

In 1999 Claus Sprick also broadcast two volumes of Asterix in Ruhr German , Zoff im Pott and Asterix his Ulligen .

Sprick lives in Bochum . He is a member of the Association of German-Language Translators of Literary and Scientific Works , VdÜ.
