Eva Schumann (born July 19, 1967 in Stuttgart-Bad Cannstatt ) is a German lawyer and legal historian . She teaches as a professor for German legal history and civil law at the Georg-August-Universität Göttingen .

life and work

Schumann studied law in Tübingen and Berlin . After her legal clerkship and second state examination in Stuttgart , she worked as a research assistant for Bernd-Rüdiger Kern from 1992 , first in Tübingen, then from 1994 in Leipzig . In 1997, she was with a thesis on the right of non-marital families in quite a historical perspective doctorate . 2003 habilitation they are in Leipzig. The following year, she accepted an offer from Göttingen to succeed Wolfgang Sellert and has since headed the Department of German Legal History at the Institute for Fundamentals of Law.

She has been a member of the Göttingen Academy of Sciences since 2007 . She is chairman of the research commission “Function of the Law in Past and Present” and in this capacity has published several anthologies with the research results of this commission.

In 2007 Schumann organized a lecture series on the subject of “Continuities and caesuras” with the participation of u. a. Joachim Rückert , Ralf Frassek , Werner Heun , Ewald Grothe , Peter Derleder , Joachim Perels and Helmut Kramer . The anthology that was subsequently published received positive reviews. Schumann himself contributed an investigation into the history of the law and political science faculty. It demonstrated three turning points in the faculty's history: from 1933, the Göttingen teaching staff, which consisted of an above-average number of Jewish legal scholars, was largely replaced by a group of young lawyers close to the Nazi ideology ( Wilhelm Saure , Georg Erler , Wilhelm Ebel , Ulrich Scheuner and others), all of whom were removed from service after 1945 and were in turn replaced by unencumbered persons ( Werner Flume , Ludwig Raiser , Hans Thieme and others) or formerly expelled from the faculty ( Gerhard Leibholz , Julius von Gierke , Herbert Kraus ); From 1954 onwards, however, she established a new turning point she called renazification with the appointment of numerous members of the former Kiel school , e. B. Friedrich Schaffstein , Ernst Rudolf Huber and Franz Wieacker . Even later, Schumann dealt with the legal history of the Nazi era , u. a. in a public lecture on the work of the Academy for German Law (2018).

In current law, she mainly conducts research on medical and family law . Her approach is to develop answers to legal questions from a perspective of legal history and comparative law . Her inaugural lecture in Göttingen represents an interdisciplinary approach to euthanasia , in which she also pointed out possible reform proposals.

Schumann made several comments on family policy . She is of the opinion that since the 7th Family Report of the Federal Government in 2006 a new family policy has been introduced in Germany, in the course of which criteria for evaluating economic processes are increasingly being transferred to the family. She has addressed this process in the media as the “ economization of the family”. Furthermore, she prepared an expert opinion for the 72nd German Lawyers' Conference in 2018, which asks about the need for reform with regard to shared parental responsibility . The considerations expressed by Schumann also found attention outside the legal world.
