The gastronomy is an independent branch of industry in Austria.

Trade Regulations

The trade regulations differentiate between the following types of operation in relation to Section 111 (5), which requires that a type of operation be specified when registering a business . These modes of operation are not specified by law, the different manifestations are defined "by the economic conditions and the public opinion ". The different types of business are characterized by the characteristics of the business premises and a specific management, but the mere naming of a location or name additions do not justify a special type of operation. The individual forms are subject to different requirements with regard to the permitted offer and the hospitality license and the operator's certificate of competence , and different opening and curfew hours during the opening times (state law).

These operating modes can be combined with one another, such as restaurants and cafeterias in hotels, bars in restaurants, but then usually require separate business licenses and sometimes also structural measures such as separate entrances and sanitary areas. Special provisions apply to any outdoor dining area . In principle, gastronomy that is not subject to commercial obligations is renting out private rooms (domestic and, to a small extent, part-time work by family members), vacation on the farm and tavern (on farms).
