The Köpi (also Kopi is a 1990) occupied and 1991 legalized house in the Kopenickerstrasse 137 in Berlin district of Mitte , which today as autonomous housing project and cultural center is used. The garden is used as a wagon place .

General

The building that still exists today is a five-storey former rear building with the remains of two side wings. The property area of ​​the house is 1904 m². Since the area is designated as a “ mixed area ” by the city planning office in Mitte , commercial use is possible up to 50 percent.

On the building the inscription “The border does not run between the peoples, but between above and below” was visible in meter-sized letters at the height of the top floor until a neighboring new building was erected. Internationally, the Köpi is as well known as Ungdomshuset in Copenhagen , which was demolished in March 2007 .

After the renovation by the squatters, there is living space for around 60 people as well as various event rooms. According to the police, only 29 residents are registered.

In 1905, the Wilhelminian style building was built by a Jewish client. In 1934 the house changed hands. In the GDR , the building was publicly owned , after the political change , the property was returned to the former owner.

Occupation and legalization

Shortly after the fall of the Berlin Wall , vacant houses in East Berlin were occupied - including by West Berliners . On February 23, 1990, they occupied the house at 137 Köpenicker Strasse, which had recently been demolished and was to be demolished. Neither the municipal housing administration (KWV), as administrator of the house, nor the East Berlin police took action against the occupation.

After the final unification, the first evictions took place in East Berlin. In response to the fierce street battles during the evacuation of Mainzer Strasse , the Mitte district called a round table aimed at legalizing the occupations. In the summer of 1991, the Köpi was legalized by the conclusion of a preliminary contract between residents and the housing association Berlin Mitte mbH , as the successor to the KWV. This preliminary contract comprised all the communally or commercially used rooms at Köpenicker Strasse 137 and included structural self-help and individual rental agreements.

In the same year, the autonomous Black Canal housing project was built nearby . On May 1, 1993, the Society for Urban Development (GSE) took over the administration of Köpenicker Strasse 137 on behalf of WBM. The individual rental agreements were concluded with GSE.

Retransfer

The building was returned to Volquard Petersen in 1995. From October 1, 1995, Petersen und Partner KG took over management on behalf of the new owner. One year later the Köpi was terminated without notice and they were asked to leave the house within a week. After the residents did not respond to a second dismissal in November 1996, Petersen und Partner KG filed an eviction action with the Berlin-Tempelhof district court in December 1996 . However, this initially declared that it was not responsible and finally the lawsuit was dismissed.

The reason for the termination without notice was the building plans of Petersen und Partner KG , who wanted to build an office building with an underground car park on the property and modernize the rear building. Although the building permits from the Mitte district were in place, they were not implemented because Petersen had to file for bankruptcy.

Foreclosure

A compulsory administration of the property in April 1998 failed. At the request of the creditor banks of Petersen und Partner KG , Köpenicker Strasse 137 and the surrounding area were to be foreclosed on February 16, 1999 . However, no interested party was found at the auction in the Mitte district court. Another auction on November 2, 1999 was canceled due to a lack of interested parties.

In 2006, Commerzbank submitted another application for a foreclosure auction to the local court. The property is extremely attractive due to its location on the Spree near the Ostbahnhof . The current value was set at 1.67 million euros for the main property and a total of 1.815 million euros for the car park area, which is divided into three auction items. On May 8, 2007 at around 9 a.m., Köpenicker Strasse 137 was sold for the lowest bid of around 835,000 euros. In the run-up to and on the day of the auction, there were rallies and demonstrations against the auction of the Köpi and the threat of eviction.

After negotiations between the residents and their lawyer, a 30-year lease was negotiated with the buyer in March 2008. Although he had bought the property on behalf of a Berlin property developer, he was entitled to sign the lease.

On September 1, 2010, the residents announced that Commerzbank was planning to auction the house again. On February 28, 2013, part of the Wagenburg an der Köpi was auctioned by Commerzbank for 405,000 euros. The buyer was Startezia GmbH, headquartered in Moers , a subsidiary GmbH the previous owner (Novum Kopenickerstrasse 133-138 GmbH & Co. KG). Another part of the car space was also sold to Startezia GmbH at another auction on August 6, 2013, disrupted by actions from the Köpi area.
