The Marida Marguerite (since the end of April 2014: Golden Oak ) is a product and chemical tanker with double hull and IMO II classification sailing under the flag of the Marshall Islands .

The ship was built in 2008 under the hull number 1007 at the South Korean shipyard Jinse Shipbuilding in Busan . The owner of the Marida Marguerite was the MT Marida Marguerite Schiffahrtsgesellschaft based in Haren , and the operator was the OMCI Shipmanagement Gesellschaft , also from Haren. The ship is one of a series of three identical ships that were built as part of a ship fund of the Hamburg issuing house Wölbern Invest. The three ships were used in the Marida tankers pool.

The ship is powered by a six-cylinder diesel engine from the manufacturer MAN B&W (type: 6S35MC-MK7) built under license by STX Engine . The engine has an output of 6060  kilowatts . For the power supply are three diesel generators each with 480 kilowatt power available.

Boarding

The Marida Marguerite was boarded by Somali pirates and brought under their control on May 8, 2010 on the way from Kandla in the Indian state of Gujarat to Antwerp in Belgium 120 nautical miles south of the Omani port city of Salala . The pirates shot at the ship with automatic weapons and bazookas . Since not all members of the 22-man crew, including 19 Indians, one Ukrainian and two men from Bangladesh , were able to get to safety in a shelter during the attack, military intervention was not initially planned, said a spokesman for the EU mission EU NAVFOR Somalia - Operation Atalanta .

On May 9, 2010, the hijacked chemical tanker set course for Somalia. On December 25, 2010, almost eight months after the kidnapping, the pirates released the Marida Marguerite . According to their own statements, they received a ransom of $ 5.5 million, which was parachuted onto the ship's deck.

In early 2011, it became known that the kidnapping had been subjected to massive torture. The pirates carried out mock executions. The seafarers had to wait 40 minutes naked in the freezer of the ship, they were tortured to the point of suffocation with cable ties around their genitals and plastic bags over their heads.

Arrests and trials of pirates

In May 2013, a Somali asylum seeker with false papers was arrested in Giessen . He is under strong suspicion of having been involved in the kidnapping and hostage-taking. He was identified by his fingerprints, which had been found on the ship. According to the public prosecutor's office, he partially confesses. Considerable effort was made before the process began. Somali pirates imprisoned in the USA were interrogated and former hostages were flown in from India, seriously incriminating the detainees. On December 20, 2013, the Osnabrück public prosecutor brought charges against the imprisoned alleged pirate. The trial began on January 29, 2014 (reading of the indictment). The verdict was pronounced on April 17th: Twelve years imprisonment for extortionate kidnapping and particularly serious extortion. The defense lawyers appealed, but this was rejected by the BGH in mid-April 2015.

On March 13, 2015, another alleged pirate was arrested while attempting to enter Germany. He was noticed in the area of ​​the Kiefersfelden border crossing during a no-suspicion control in an Italian coach because of a forged Italian passport. As a result, his fingerprints were taken and found that they had been registered on the Marida Marguerite as part of the very thorough search for clues by Lower Saxony investigators . The arrested man tried to pretend to be 16 years old when establishing his personal details, but was in fact 23 years old.
