Sabrina Setlur (born January 10, 1974 in Frankfurt am Main ) is a German rapper . She sold more than two million records between 1995 and 2007 and is the first female rapper to score a number one hit in the German single charts . She has not released another album since 2007.

Life

youth

Sabrina Setlur was born as the daughter of Indian immigrants in Frankfurt am Main and spent a large part of her childhood in middle-class circumstances in the Taunus suburbs of Bad Soden am Taunus and Schwalbach am Taunus . In upper school at the Liebigschule in Frankfurt , she met Thomas Hofmann, who later co-founded the Pelham Power Productions ( 3P ) label . This encouraged Setlur in 1993 after a spontaneous performance to Dr. Dres Nuthin 'but a' G 'Thang on the later Rödelheim-Hartreim project production When it's not hard to rap. She dropped out of business studies and signed a record deal with 3P .

Career

1990s

In 1995, Setlur released the double A single, produced by Moses Pelham , under her pseudonym Sister S. Here comes the sister / Pass on . The final breakthrough came with the follow-up single Ja klar ; Their debut album S ist so far followed in February 1995 (number 11). The following year Setlur received the Echo Pop in the category “Artist National”. She also got her own hip-hop show on the radio station hr3 .

After a sales change from 3P , Setlur released their second album Die neue S-Klasse for the first time under their real name in 1997 . The record reached number ten on the German album charts and sold more than 300,000 times within a few months, which was largely due to the number 1 hit Du love me not . While she received another ECHO as well as a Comet as "Künstlerin National", the album with Do you believe me? , Just me and follow the star three more hit singles. In 1999 she could also be heard on the Faithless single Bring My Family Back . In the same year she had her single Freisein sing by Xavier Naidoo , as she did not consider herself a singer, but a rapper. There is a legal dispute with the Kraftwerk group over a possible copyright infringement over the song Nur mir .

In 1999 Setlur's third studio album was finally released from the point of view and with the words of… . The record reached number 3 on the album charts and earned the rapper her third ECHO . Setlur then released a top 20 hit with Alles , the theme song recorded with Xavier Naidoo for the box office hit Anatomie .

2000s

The album Sabs , released in November 2003, reached number eleven in the German charts and produced four successful singles with Ich bin so , Liebe , Baby and Mein Herz . At the same time, Setlur drew attention to herself through her participation in the German preliminary decision for the Eurovision Song Contest as well as through her involvement in the fourth season of the casting format Popstars and shortly afterwards published her Best-Of-Collection 10 years .

From 2006 on, Setlur worked on her sixth album Rot , which was released on August 24, 2007. The first single was the song Lauta , which was released on August 3, 2007 in three different versions as a maxi. This song was based on 25 Years by The Catch from 1983 . The accompanying clip premiered on June 21, 2007 on MTV.

The second single, I Think I Like It , which is sung in English, German and French, was released on November 9, 2007. This single, like the album Rot , was not very successful commercially despite positive reviews; both releases dropped out of the Media Control Charts after just two weeks. As a result, no further singles were decoupled from red , any promotion was stopped. The tour announced for February / March 2008 did not take place.

In the summer of 2009, Setlur took part alongside Désirée Nick and Maja von Hohenzollern in the Sat.1 television program Die Promi-Singles - Traumfrau sucht Mann , which was discontinued early because of poor ratings.

Since 2014

In November 2014, Setlur ended a creative break and after five years was back on German television in the VOX show Grill den Henssler . In September 2015, she took part in the show Promi Shopping Queen and won the edition. In October 2017 she was a guest on the ZDF neo talk show Schulz & Böhmermann .

In the movie comedy Verpiss dich Schneewittchen , which was released on March 29, 2018, Setlur plays a record manager and contributes the theme song for it together with Eko Fresh . She also took part as a candidate for the second season of Global Gladiators .

In 2020 she took part in the 13th season of Let's Dance , but left after the 2nd broadcast. Her assigned dance partner was the Ukrainian dancer Nikita Kuzmin .

Sampling litigation

An example of this is the Kraftwerk case against Sabrina Setlur's music producer Moses Pelham because of the song Nur mir (September 1997) on the LP Die neue S-Klasse (March 1997), which has already concerned the BGH twice . This song is underlaid with a loop of a two-second sampling of the Kraftwerk song Metall auf Metall (LP Trans Europa Express ; March 1977). Two musicians from Kraftwerk saw this as a copyright infringement and successfully sued the Hamburg courts for an injunction. After the BGH had overturned the first judgment of the Hamburg Higher Regional Court in 2008 because of incorrect and unclear reasons and referred the matter back (judgment of November 20, 2008 - I ZR 112/06, decision key word “metal on metal”), the OLG confirmed his decision. At the oral ruling in December 2012, the BGH made it clear that even the smallest parts of a piece of music are fundamentally protected by copyright and can therefore only be removed with the consent of the author. According to the BGH, copyright law provides for an exception to this rule in order to promote cultural creation. According to this, a musician is allowed to take such sound sequences from other pieces if they could not simply be replayed because of their special character (judgment of December 13, 2012 - I ZR 182/11, decision key word “Metal on Metal II”).

Conversely, however, according to the BGH, this means that those who want to use the sounds for their own purposes and are “able and authorized to record them themselves” are not allowed to take them over by way of sampling . Tone sequences that clearly come from another sound carrier and form a melody may not simply be adopted. The point was that in 1997 Setlur had taken a two-second two-bar rhythm sequence from Kraftwerk Metall auf Metall and assigned its title Nur mir in continuous repetition . The BGH came to the conclusion that it would have been possible to play in the rhythm sequence that was adopted, so that Kraftwerk's rights were violated. The right to free use according to § 24 Abs. 1 UrhG is only available to someone who plays a sequence of notes himself and thus a reproduction is possible for factual reasons.

Pelham lodged a constitutional complaint against this decision. The BGH had inappropriately taken into account the freedom of art. The Federal Constitutional Court accepted the constitutional complaint and dealt with it - according to the Chairman of the First Senate, Ferdinand Kirchhof - for the first time in its history with constitutional questions of copyright. In its decision announced on May 31, 2016, the BVerfG overturned the decision of the BGH. He misjudged the scope of artistic freedom. The use of samples is one of the style-defining elements of hip-hop. In addition, the criterion of "replayability" is unsuitable.

This is the third time that the BGH will have to decide the matter. By order of 1 June 2017, the Supreme Court has stayed the first local procedures to European legal aspects of the dispute in the context of a preliminary ruling by the ECJ to litigate. On April 30, 2020, the Federal Court of Justice ruled that Pelham should not have used the sequence because it "has not been changed, and [it] was easily recognizable".
