Wilhelm Schelsky

Wilhelm Schelsky (born October 21, 1948 ) is the former federal chairman of the workers' organization Arbeitsgemeinschaft Independent Betriebsangageiger (AUB). In the wake of a corruption scandal at Siemens , he was sentenced to imprisonment in 2014 and to a compensation payment of € 3.2 million in 2009 .

Life

Wilhelm Schelsky is the son of the sociologist Helmut Schelsky . In 1969 he put the Abitur at the Godesberger Otto Kühne School off, then spent several semesters studying law in Bonn and then made a business education , after their graduation, he worked in sales of Siemens. In 1984 he took over the management of the working group of independent employees and was chairman of the works council of the Erlangen- Mitte location . In 1990 Schelsky started his own business as a consultant , mainly working as a lobbyist for Siemens and organizing training courses for the company.

Siemens affair

On February 14, 2007, Schelsky was taken into custody on suspicion of having received millions in payments from Siemens for alleged consulting services between 2002 and 2004. The prosecution went on to say that the money was used to build the AUB as a counter-organization to IG Metall . During the process it emerged that between 2001 and 2006 he had received over 30 million from Siemens for the establishment of the AUB, which had changed the co-determination of the works council significantly in favor of the employer. Schelsky admitted having received money and evaded taxes , but denied criminal intent and manipulation. IG Metall described Schelsky's actions as a “clear violation of the Works Constitution Act” and spoke of “tame works councils”.

Condemnation

After 21 months of pre-trial detention, he was sentenced in November 2008 to four years and six months in prison for embezzlement , fraud and tax evasion, and Siemens manager Johannes Feldmayer , who was also accused, was sentenced to two years probation and a fine of € 228,000. In a civil proceeding at the beginning of September 2009, Schelsky was sentenced to pay damages of € 3.2 million to Siemens because he had accepted money without a corresponding consideration.

At the beginning of July 2009, Schelsky was released after complaining about his arrest . Against the verdict he left the Federal Court (BGH) in revision . In October 2010, the BGH granted the application on essential points and referred the case back to the Nuremberg Higher Regional Court with a limitation to the sentence.

After a three-year process delay due to the Federal Constitutional Court's inaction, Schelsky was sentenced in November 2014 by the Nuremberg Higher Regional Court to a prison sentence of four years only for fraud and tax evasion, but acquitted of the charge of infidelity. Taking into account the pre-trial detention and the long duration of the proceedings caused by the Federal Constitutional Court, the remaining sentence was suspended.

The Stump case

Schelsky was also a sponsor of VfB Forchheim . From October 2011, Franz Stumpf , Lord Mayor of Forchheim and chairman of the sports club, had to answer for tax evasion and failure to pay social security contributions before the Fürth district court . He and two other defendants were accused of having known about Schelsky's evasions of up to € 500,000 and of having been partly responsible for it. In November 2011, the proceedings were discontinued in exchange for a payment of € 20,000 to a non-profit organization .
