Central dunning court
The central dunning court or joint dunning court is the department of a local court in which dunning proceedings from the districts of several local courts are processed. These courts issue what is known as a payment order upon request (former name: payment order ).
In principle, the district court at the creditor's place of residence is exclusively responsible for dunning proceedings ( Section 689 (2 ) ZPO ). In the meantime, however, all state governments have made use of the authorization in Section 689 (3) ZPO, according to which they can “assign dunning procedures to a district court for the districts of several district courts” and even set up so-called joint dunning courts across state borders.
For example, on November 1, 2005, the joint dunning court of the federal states of Hamburg and Mecklenburg-Western Pomerania was established at the Hamburg district court and on May 1, 2007 the Aschersleben district court , Staßfurt branch , was set up as a joint central dunning court for Saxony-Anhalt , Saxony and Thuringia . The central dunning courts for the individual federal states are currently set up as follows:
- In Baden-Württemberg , the Stuttgart District Court is the central dunning court.
- In Bavaria , the Coburg District Court is responsible for all dunning procedures.
- In Berlin and Brandenburg , dunning procedures based on a state treaty have been processed centrally by the Berlin-Wedding district court , which was previously the central dunning court for Berlin , as the central dunning court Berlin-Brandenburg since July 1, 2006 .
- In the state of Bremen , the Bremen District Court is responsible.
- The Hamburg-Altona district court is the central dunning court for the districts of all Hamburg district courts and for Mecklenburg-Western Pomerania . It is located in the building of the former Altona district court.
- In Hesse , the central dunning court is set up at the Hünfeld district court .
- In Lower Saxony , the central dunning court is set up at the Uelzen district court .
- In North Rhine-Westphalia the dunning procedures for the districts of the higher regional courts of Hamm and Düsseldorf are processed by the district court of Hagen and those for the district of the higher regional court of Cologne by the district court of Euskirchen .
- In Rhineland-Palatinate and Saarland is by a treaty the Amtsgericht Mayen , the previously centralized dunning court of Rhineland-Palatinate was established as a central dunning both countries.
- In Saxony-Anhalt , Thuringia and Saxony , reminders are processed centrally at the Staßfurt branch of the Aschersleben district court .
- In Schleswig-Holstein , the Schleswig District Court is the central dunning court.
This list shows the responsibilities for the national order for payment procedure. In addition, the European order for payment procedure has existed since 2008 . Here a dunning court responsible for this issues a so-called European payment order . The district court of Berlin-Wedding is responsible for an applicant resident in Germany (i.e. regardless of the federal state in which he is resident) .
