The district court was then founded with the ordinance of August 7, 1852 regarding the formation of the district courts and lower administrative authorities as a royal Hanover district court. It included the office of Herzberg. The district court was subordinate to the higher court in Osterode . With the annexation of Hanover by Prussia , it became a Prussian district court in the province of Hanover .

The court has been located in the so-called " Sieber Wing " and the "Gray Wing" at Schloss Herzberg since 1852 . The largest courtroom (Hall 11) is located in the former castle kitchen. On the first floor there are two further meeting rooms and the offices of the employees, judges and district court director.

Extensive renovation work has been underway at Schloss Herzberg since 2017 . For this reason the court will move to the " Marstallflügel " for a few years .
