Career

Caleb Claiborne Herbert, son of Clarissa Jones and Nathaniel Herbert, was born and raised in Goochland County during the British-American War . Nothing is known about his youth. Before 1846 he moved with his wife Mary and his son William to Texas and settled in Eagle Lake ( Colorado County down). There he bought a plantation east of the Colorado River , twelve miles southeast of Columbus. In 1860 he was one of the wealthiest landowners in Colorado County, including 47  slaves . Herbert represented the Columbus District in the Texas Senate between 1857 and 1859 and between 1859 and 1861 . This included the following counties: Austin County , Colorado County and Fayette County .

After the outbreak of the Civil War , he joined a vigilante company at Eagle Lake, where he held the rank of captain . From June 1861, he then served as an aide-de-camp in the 10th District. This included the following counties: Milam County , Burleson County , Washington County , Austin County and Colorado County. During that time he held the rank of colonel . In November 1861 he was elected to the First Confederate Congress for the Second Constituency of Texas , where he took up his post on February 18, 1862. During that time he sat on the Committee on Ordnance and Ordnance Stores, the Committee on Post Offices and Post Roads, and the Committee to Investigate the Castle Thunder Prison. In 1863 he was elected to the second Confederate Congress , where he worked until 1865. During that time, he served on the Committee on Claims, the Committee on Commerce, and the Committee to Investigate the Stewart Hospital. Because of the Confederate Conscription Act, he called for the secession of Texas from the Confederation .

After the end of the Civil War, he was elected to the 39th US Congress in 1865 and the 40th US Congress in 1867, each for the fourth constituency of Texas. His congress seat was withdrawn from him on both occasions because he did not want to take the required oath ( Ironclad Oath ). In January 1867 he represented Colorado County at a landowners meeting in Houston , where alternatives for the freed slaves in agriculture were sought. Because of a mix-up, he was shot in public on July 5, 1867 in front of a saloon in Columbus. He was buried on his plantation at Reel's Bend on the Colorado River.
