Götz Frank

Götz Frank (born November 6, 1944 in Wewelsburg ) is a German constitutional lawyer .

Life

From 1964 to 1969 Frank studied law at the Universities of Frankfurt and Kiel . In 1965 he became a member of the Corps Austria . In 1972 he did his doctorate at the University of Konstanz and then passed the second state examination in Stuttgart . From the end of the 1970s he was a lecturer at the University of Hanover , where he completed his habilitation in 1979. In the following years he was visiting professor and professor at various universities in Germany and abroad ( Bonn , Frankfurt , Hamburg and Münster as well as Brest , Le Havre , Beijing , Rouen and La Coruña ). Since the winter semester 1989/1990 he has held the chair for public commercial law at the University of Oldenburg . In teaching, he was particularly involved in the area of ​​internationalization. He built double degrees with French university partners (Brest and Le Havre). Together with the Universities of Groningen and Bremen , he was responsible on the Oldenburg side for the establishment and development of the European legal training at the Hanse Law School .

Since the 17th edition in 2000, Frank has been the author of the standard work on Staatsrecht founded by Ekkehart Stein .

Positions

In his early writings, Frank developed a constitutional dogmatic justification for the peace mandate in the Basic Law as a state objective . On this basis, his commentary on the military constitution in the alternative commentary on the Basic Law was created . The main idea behind his commentary was the overarching principle of democratic control and the reduction of the military to the necessary extent. Based on this, he has been of the opinion since the early 1990s that after the end of the East-West conflict, maintaining a conscript army was no longer constitutionally tenable.

In the discussion on broadcasting law, since the fourth broadcasting ruling by the Federal Constitutional Court, he has advocated stricter compliance with the requirement of distance from the state in public broadcasting. Any kind of party-political appropriation of broadcasting met with sharp criticism.

In September 2019 he was one of about 100 constitutional law teachers who, with the open appeal for the right to vote, Downsized the Bundestag! turned to the German Bundestag .
