Hermann Lei (born November 5, 1972 ; resident in Berneck ) is a Swiss lawyer and politician ( SVP ).

biography

Hermann Lei is the son of the FDP politician of the same name, Hermann Lei . He grew up in Weinfelden , attended the cantonal school in Frauenfeld and the Kreuzlingen teacher training college and studied law , completing his studies in July 2001. He has been running a law firm in Weinfelden since 2005. He is a member of the Thurgau and Swiss Bar Associations.

From December 2009 to March 2011 he was president of the management of the document management make the National Archive and Backup cooperative NABUG in Winterthur, which under nabug.ch had operated a platform for the electronic filing of business documents. Since December 2009 he has also been a member of the board of directors of the Messen Weinfelden cooperative , which organizes the WEGA autumn fair, which is important for the region. His father of the same name was already a politician. He belonged to the FDP and was government councilor of the canton of Thurgau from 1992 to 2002 and resigned as chairman of the board of directors in 2002 as one of the main responsible for the bankruptcy of the Mittelthurgau railway .

Hermann Lei was 2007/08 member of the municipal council of Frauenfeld and sitting since 2007 for the SVP in the Grand Council of the Canton of Thurgau . He was the first president of the Frauenfeld Naturalization Commission, from which he resigned at the end of May 2015. Lei fought in 2009 against the extension of the free movement of persons , sat down at a vorderster Front for the minaret initiative and is opposed to the connection of the Swiss franc to the euro by the Swiss National Bank .

Hildebrand affair

Lei played a central role in the Hildebrand affair surrounding the then President of the Board of Directors of the Swiss National Bank, Philipp Hildebrand . According to the President of the Bank Council, Hansueli Raggenbass , Lei received stolen customer data from Bank Sarasin on a Hildebrand account and forwarded it to Christoph Blocher . This presented them to Federal President Calmy-Rey . Lei, who is represented by lawyer Valentin Landmann , also forwarded the documents to Weltwoche journalist Urs Paul Engeler . In the course of this affair Hildebrand resigned. Lei received a formal admonition from the board of the Thurgau Bar Association (TVA) because of his joy over Hildebrand's resignation, which was shown in rude words in the media. On January 13, 2012, a criminal investigation was initiated against Lei and the Zurich SVP cantonal councilor Claudio Schmid (now suspended) for violating the Banking Act ( Art. 47 BankG) or participating in it. Lei is also accused of violating professional secrecy. Various house searches and interviews took place. On January 25, 2012, Lei resigned from the Justice Commission of the Thurgau Grand Council. In 2013, the public prosecutor issued a penalty order against Lei for attempted incitement to and assistance in violating banking secrecy and multiple violations of written secrecy . The business and professional secrecy violation proceedings have been terminated. Lei raised an objection to the penalty order, so that on March 30, 2016, a trial before the Zurich District Court took place. In the appeal process, the Higher Court found Lei guilty on August 23, 2017 for helping to breach railway secrecy. However, going to the media was justified because, given the foreign exchange transactions of the National Bank President, there was at least the suspicion that Philipp Hildebrand had acted “highly morally reprehensible” and thus “scandalous behavior”.

Controversy

In 2012 the weekly newspaper (WOZ) wrote that until recently , Lei was registered as the holder of the internet address adolf-hitler.ch with the key word AG, Hermann Lei and the address of his law firm. According to Lei, it should be a mistake, he was never the owner of the Internet address, it belongs to one of his customers. The website is supposed to be an educational page that refers to the horrors of National Socialism. Lei took legal action against the reporting of the WOZ. The responsible journalist Carlos Hanimann was acquitted in the first instance by the Zurich District Court of the allegation of personal violation, Lei and Hanimann then ended the proceedings by settlement after Hanimann had expressed his regrets. The newspaper Tageswoche compensated Lei for similar statements with CHF 5000 and also expressed its regret.

In the course of the "Hildebrand Affair", a man referred to Hermann Lei on Facebook as a "dirty liar", "fool" and "criminal". The man was charged with multiple abuse and was acquitted in the last resort.
