Preliminary investigation

On the basis of a criminal complaint filed by the Basler Privatbank J. Safra Sarasin in Zurich in connection with the corrective reports on cum / ex and cum / cum transactions ( CumEx files ) since 2014, the Zurich public prosecutor's office has been investigating Schröm on the accusation of Industrial espionage and the violation of trade secrets . She filed an application for the Hamburg public prosecutor to take over the proceedings, which has therefore been investigating Schröm since the end of May 2018 on suspicion of inciting the disclosure of company and business secrets. The chairman of the German Association of Journalists (DJV), Frank Überall , described the procedure as an attack on the freedom of the press . Schröm spoke of an attempt to criminalize investigative journalism.

The Correctiv editorial team published an open letter on December 11, 2018, specifically to Justice Minister Katarina Barley and Finance Minister Olaf Scholz . "It is the first time that this paragraph [§ 17 UWG] is applied to a journalist," it said.

In mid-July 2019, the Hamburg public prosecutor announced that they had discontinued the investigation against Oliver Schröm: "There is no sufficient suspicion to justify further investigation or indictment."
