Carl Franz Otto Karlowa (born February 11, 1836 in Bückeburg , † January 3, 1904 in Leipzig ) was a German legal scholar , legal historian and Romanist . From 1867 he was Professor of Law at the University of Greifswald and from 1872 to 1903 at the University of Heidelberg .

Life

family

Otto Karlowa came from an old originally Bohemian family who emigrated to Braunschweig in the 16th century because of the persecution of the faith at the time . His father Johann Hermann August Capaun-Karlowa (1804–1875) was initially a judge and councilor in the Principality of Schaumburg-Lippe and later an appellate judge in Wolfenbüttel , his mother Sophie was born Thornten. She came from Holstein but was of British descent. Otto was one of six children, five sons and one daughter, of the couple.

Professional background

Karlowa attended high school in Wolfenbüttel. After graduating from high school , he studied law and history at the universities of Göttingen , Berlin and Jena from 1854 . His professors included Hans Karl Briegleb , Johann Heinrich Thöl , Georg Waitz and Wilhelm Franz Francke . As a student in Göttingen, he was awarded a prize for a legal thesis. In 1859 he passed the first state examination in law and took a position as an auditor at a law firm in Bückeburg.

In 1862 Karlowa received his doctorate at the University of Bonn with the dissertation De natura atque indole synallagmatos, quod emptioni, venditioni, ceterisque obligationibus mutuis inesse dicitur for Dr. jur. Just a few months later , he completed his habilitation as a private lecturer at the University of Bonn. In the autumn of 1867 he accepted the call to the University of Greifswald as a full professor for civil procedure and criminal law as well as Roman law . At Easter 1872 Karlowa was appointed in the same capacity to succeed Levin Goldschmidt at the University of Heidelberg . He worked here for over 30 years and was also appointed dean of the law faculty.

Karlowa was the author of numerous specialist publications. While still in Bonn, he wrote articles on the history of the Roman civil process in 1865 and the forms of Roman marriage and manus in 1868 . In 1878, on the occasion of the 70th birthday of Grand Duke Friedrich von Baden, he wrote a highly regarded contribution to the appointment of members of the law faculty of Heidelberg University. His study published in 1877 The legal transaction and its effects was used for the preparatory work on the BGB . In 1879 he turned down a well-endowed call to the Würzburg University . As a thank you, Karlowa received the title of Privy Councilor with the title Excellency . His main work, Roman Legal History , on which he had worked for 20 years and which remained unfinished, appeared in two volumes in 1885 and 1901. It was re-published as a reprint in 1998 . Karlowa was a member of the Baden District Council for the National Liberals for several years .

Since 1897 he has been teaching the introduction of the Civil Code for the German Empire, which came into force on January 1, 1900. In addition, he offered seminars on private law as well as lectures on Roman law and family and inheritance law. Students and colleagues noticed for some time that he was no longer in full possession of his mental powers. He suffered increasingly from Alzheimer's disease . From the summer semester of 1903, Karlowa was released from his university obligations. In the same year he was awarded the Commander's Cross 2nd Class of the Order of the Zähringer Lion for his services .

Marriage and offspring

Otto Karlowa married Hermine Leuckart in 1873, the daughter of the Leipzig zoologist and founder of parasitology Rudolf Leuckart . The marriage resulted in seven sons.
