Referendum in Italy 2011

An abrogative referendum was held in Italy on June 12 and 13, 2011 , and four questions were asked. 47,118,352 Italians and 3,300,496 Italians living abroad were called for a referendum to decide on the following questions:

  • The first question was the proposal to abolish Art. 23 bis of Law No. 133/2008 on the privatization of public services with economic importance.
  • In the second question, the abolition of Art. 154 of Legislative Decree 152/2006, limited to that part of Paragraph 1, which provides that the tariffs for the water service are set in such a way that they “refer to the remuneration of the invested capital are appropriate ”, suggested.
  • In the third question, the abolition of decrees no. 99/2009 and no. 31/2010, which provide for Italy's re-entry into nuclear energy , was offered as an option. On May 26, 2011, however, the Berlusconi government passed an omnibus law which repeals the above articles for a period of 12 months. After the government's proposal to abolish the referendum was rejected by the Corte Suprema di Cassazione (Supreme Court of Cassation) on June 1, 2011 and the appeal to the Constitutional Court also approved the referendum, this question was asked nonetheless.
  • The fourth question concerned the abolition of the provisions of Law No. 51 of April 7, 2010, as amended by the judgment of the Constitutional Court No. 23/2011 in the area of ​​“lawful prevention of the Prime Minister and Ministers from appearing for criminal proceedings', the so-called Lex Berlusconi or legittimo impedimento .

The referendum was only legally binding if the necessary quorum of 50% plus one vote, i.e. 25,209,425 votes, was achieved.
