Tobias Christoph Huch (born August 10, 1981 in Mainz ) is a former German entrepreneur and politician ( FDP ). Since August 2014 he has been involved in humanitarian aid for Kurdish refugees in Iraq and Syria . He now works full-time as a journalist , publicist and book author .

Huch was managing director of various companies:

In 2000, at the age of 18, Huch founded Erodata GmbH . This operated the age verification system ueber18.de and later traded under the name Resisto IT GmbH . Huch has received an Eroticline Award three times with this company : In 2005, ueber18.de was recognized as the “best youth protection system”; In 2006 Huch received an honorary award “for his commitment to the industry” and in 2007 an honorary award “for special merits in merging online / offline”. Resisto IT GmbH was dissolved on June 5, 2013 after the opening of insolvency proceedings .

In addition, Huch was the managing director of Raucherabo.de UG , registered on May 19, 2010 , which traded in tobacco products. The company was deleted on March 13, 2014 due to lack of assets . He was the managing director of BAB MEDIA GmbH (until the beginning of February 2011: Huch Medien GmbH ) in Mainz. As of September 26, 2017, he was replaced as managing director by Wolfgang Huch. The company was dissolved on February 5, 2018.

Huch was managing director of Tobias Huch GmbH , which was registered on August 16, 2001 and dealt with corporate investments and asset management. As of September 19, 2017, he was replaced as managing director by Wolfgang Huch. The company was dissolved on February 1, 2018. Huch was also the managing director of Private.Ki GmbH , which dealt with e-mail encryption. In June 2016 insolvency proceedings were opened and a preliminary insolvency administrator was appointed. The company was deleted on March 7, 2018.

Huch moved abroad in 2016. In June 2017 he announced that he would no longer work as an entrepreneur, but as a “consultant, refugee worker and publicist”.

tax evasion

On May 7, 2012, Huch was sentenced to a year and three months imprisonment by the Koblenz Regional Court for tax evasion , the execution of which was suspended . The court found that, as the de facto co-managing director, he ran a Swiss IT company from Germany, but had evaded the sales tax of around EUR 800,000 that was incurred in Germany from 2004 to 2007 . In addition, Huch has to pay 75,000 euros as a probation condition. The judgment is final, as the public prosecutor and Huch waived an appeal. After the verdict, Huch stated that he had not personally enriched himself and that he broke off the defense to protect his family, his environment and his company.

On June 3, 2017, the same court sentenced Huch to one year and six months' probation for tax evasion.

Constitutional complaint against § 184d StGB

In 2005 Tobias Huch filed a constitutional complaint with the Federal Constitutional Court in Karlsruhe against § 184c StGB (today: § 184d StGB). The motion was to repeal Section 184d of the Criminal Code, insofar as it relates to the distribution of so-called soft pornography in tele and media services. In a related proceeding, the constitutional complaint was not accepted for decision.

Trial against Arcor

At the end of 2007, Huch and his company Huch Medien GmbH, as the operator of the Amateurstar.de website and as the provider of an age verification system , sued the Internet access provider Arcor . Huch asked Arcor to block the search engine Google , which makes pornographic material accessible via search queries without youth protection measures. Tobias Huch planned to use the lawsuit to test the scope of the exemption from liability for providers. The Court of Appeal confirmed in its decision of 22 January 2008 that an Internet access provider, even from the standpoint of competition traffic duty for the content of websites to which it provides access to its customers, in principle, not responsible is (ref. 6 W 10 / 08).

T-Mobile data scandal

The Spiegel reported in issues 41 and 42 of 2008 about a data scandal at T-Mobile . Huch told the magazine that he came into possession of large amounts of customer data in 2006 "by chance and by indirect means". He contacted Deutsche Telekom in 2006, which at that time was already informed of the circulating copies of its customer data. The business premises of Tobias Huch's company Resisto IT GmbH were searched by the public prosecutor's office in October 2008, shortly after the vulnerability became known to the public. The company was regarded as a so-called "unsuspected witness". The database was deleted from Huch's business computer by an expert from the data protection supervisory authority who was later called in by overwriting it seven times.

Interim injunction due to the youth protection system of Sky Deutschland

In May 2010, Huch's company Resisto IT GmbH, as the operator of an age verification system, obtained an injunction from the Duisburg district court against the pay-TV operator Sky Deutschland . The reason for this was that some of the smart cards used by Sky, those of the Swiss encryption provider Nagravision , could calculate the factory-set youth protection PIN. Huch took the position that the age verification system used by Sky offers insufficient protection of minors, although both the Bavarian State Center for New Media responsible for Sky and the Commission for Youth Media Protection consider the system used by Sky and various cable network operators to be sufficient. Because of this temporary injunction, Sky was temporarily forced to broadcast the erotic channel Beate-Uhse.TV only from 11 p.m. and to broadcast various other content at a later point in time or in shortened form. Other channels broadcast via Sky, such as RTL Crime , were also affected.

Sky reacted to this process at the beginning of August 2010 and requested some of its customers in writing to change their youth protection PIN. Tobias Huch expressly welcomed this step by Sky Deutschland, but also described it as a disgrace for the responsible Bavarian State Media Authority (BLM) and the KJM (Commission for Youth Media Protection). Huch withdrew the action before the Düsseldorf Higher Regional Court and waived the main action. This ended the proceedings.

Support for Karl-Theodor zu Guttenberg in the plagiarism affair

In February 2011, Huch organized an unofficial campaign on Facebook under the title “Against the Hunt for Karl-Theodor zu Guttenberg ” when the then Federal Minister of Defense came under fire in the plagiarism affair because of his dissertation .

Satirical redesign of the coat of arms of North Rhine-Westphalia

During the election campaign for the state elections in North Rhine-Westphalia in 2012 , a caricature of the coat of arms of North Rhine-Westphalia appeared on the Facebook page of the FDP-related discussion and action platform FDP Liberté. Tobias Huch and Hasso Mansfeld were responsible. On the redesigned coat of arms, a "bankrupt vulture" replaced the jumping horse in the red field, including the party name SPD ; on the other, green side was a stylized motorway with a speed limit of 120 sign and the logo of Bündnis 90 / Die Grünen . "With this I am criticizing the debt policy of the SPD and the transport policy of the Greens in North Rhine-Westphalia", commented Huch when the SPD politician Björn Seelbach filed a complaint against FDP Liberté in September 2012 for denigrating a country symbol . With the ad, Seelbach got himself a shit storm on the Internet in which he was accused of lack of humor and disregard for freedom of expression.

Political functions

Huch has been chairman of the Young Liberals Rheinhessen-Vorderpfalz since January 2011 and also deputy chairman of the Young Liberals Rhineland-Palatinate for several years. He was also chairman of FDP Liberté , an FDP-affiliated association with the same name on Facebook, through which the supporters developed ideas for the election campaign and exchanged ideas about the future of the FDP.

According to his own information, Huch has UN accreditation from the Republic of Liberia .

Huch wrote in the Bild newspaper in February 2014 that he had written homework for befriended students (and thus helped with cheating). Thereupon he was asked by the FDP Mainz to resign. Since Huch did not comply with this request, a party order procedure was initiated in April 2014. The party proceedings were set in July 2014. The party court could neither find a violation of the statutes nor damage to the party. In 2016 Tobias Huch moved to an unknown place of residence outside of Germany and ended his active political career. In mid-2016 he was appointed to the Advisory Board of the Kurdish Community in Germany by the CDU politician Ali Ertan Toprak.

Emergency aid in Kurdistan

Together with the restaurateur Gunter Völker who lives in Erbil, Germany, Tobias Huch founded the “Water for Refugees in Kurdistan” initiative in August 2014. In September 2014, according to Huch's statements, the initiative delivered 20,000 to 30,000 bottles of drinking water to the refugees in northern Iraq every day.

In September 2014, together with Steven Wink and Burkhardt Müller-Sönksen , Huch founded the non-profit association “Liberal Refugee Aid” in order to be able to organize and expand aid even better. Liberal Refugee Aid collects money for drinking water, medicine, baby food and blankets to provide for refugees in the Kurdistan Autonomous Region , Iraq and Rojava (Northern Syria). The initiative reached a level of over 2 million water bottles shipped in June 2016 and 2.9 million water bottles shipped in February 2018.
