Constitutional article "for quality and economy in health insurance"

The constitutional article "For quality and efficiency in health insurance" is a counter-draft to the withdrawn Swiss popular initiative "For lower health insurance premiums in basic insurance". It was launched by the Swiss People's Party and is occasionally called the premium reduction initiative .

On January 16, 2003, the SVP launched the federal popular initiative “for lower health insurance premiums in basic insurance”, which was previously signed by 101,226 Swiss voters based on the right of initiative under Article 139 paragraph 3 of the Federal Constitution . Its aim was to reduce health insurance premiums, which should have been achieved, among other things, by reducing the catalog of benefits.

After Parliament had spoken out against the initiative because, among other things, the text of the initiative had not stated which services would be affected, a counter-draft was drawn up. The initiative committee, consisting of 25 members, had withdrawn the initiative with 18 to 7.

The constitutional article was put to the vote on June 1, 2008 and was rejected.

The Federal Constitution of April 18, 1999 is amended as follows:

Art. 117a Health Insurance (new)

  1. Health insurance is based on:
    1. basic insurance according to social security law, which bears the costs for medical and nursing services that are useful for pain relief, healing and reintegration, are appropriate and economical, and whose effectiveness is recognized by science;
    2. supplementary insurance under private insurance law.
  2. Basic insurers and service providers conclude service contracts that meet the needs of the insured.
  3. Basic insurers may not be involved in service providers and service providers may not be involved in basic insurers.
  4. The basic insurance is financed by contributions from the federal government and the cantons of a maximum of 50 percent together as well as contributions from the insured.
  5. The federal government and the cantons make their contributions to the basic insurers.

The transitional provisions of the Federal Constitution are changed as follows:

Art. 197 no. 2 (new)

  1. Transitional
    provision to Art. 117a (health insurance) The provisions of the new Article 117a come into force 3 years after their acceptance by the people and the cantons. The Federal Council issues the necessary enforcement provisions by ordinance until they are replaced by legislation. Until the point in time when Article 117a comes into force, the insured persons can insure the difference to the previous scope of benefits with their basic insurer under the supplementary insurance without reservation.
