The political police in Saxony-Anhalt under Soviet occupation arose after 1945 from internal DKP apparatus (the “party political department” and “border apparatus / traffic”) and from 1947 the so-called “Kriminalpolizei 5” or “K5”. After the reunification and peaceful revolution in the GDR , the more than three times the number of civil servants in the GDR employed at the same time in the public service of the comparably large state of North Rhine-Westphalia could not all be taken on. Therefore, the compromise was reached that each department “should take responsibility for the personnel incumbent on it and establish transition rules”. When the Law on the Protection of the Constitution in the State of Saxony-Anhalt came into force on July 30, 1992, the then State Office for the Protection of the Constitution of Saxony-Anhalt began its work. The former chief detective and owner of the Frankfurt company KDM Sicherheitsconsulting, Klaus-Dieter Matschke, was involved in setting up the State Office for the Protection of the Constitution in Saxony-Anhalt.

With the law amending the law on the protection of the constitution in the state of Saxony-Anhalt of March 30, 1999, the state office for the protection of the constitution of Saxony-Anhalt was incorporated as a separate department in the then Ministry of the Interior (now: Ministry of the Interior and Sport) of the state of Saxony-Anhalt.   3. security-endangering or secret service activities for a foreign power within the scope of the Basic Law
  4. Efforts within the scope of the Basic Law that endanger foreign interests of the Federal Republic of Germany through the use of force or preparatory actions aimed at it,

The Saxony-Anhalt constitutional protection is subject to the control of the state parliament of Saxony-Anhalt . This task is performed in particular by the Parliamentary Control Commission. This meets in secret and is bound to secrecy. The state government has to inform the Parliamentary Control Commission comprehensively about the general activities of the Saxony-Anhalt constitutional protection authority and about events of particular importance. The Parliamentary Control Commission, which consists of five members of the state parliament, meets at least quarterly. It has the right to provide information, to inspect documents, to have access to facilities for the protection of the constitution and to be heard from informants.

The Office for the Protection of the Constitution is also controlled by the State Commissioner for Data Protection, the State Audit Office and the courts.
