Federal support center for asylum seekers

The federal care centers for asylum seekers in Austria provide care and basic care for asylum seekers and other foreigners in need.

  • the Asylum Reception Directive 2003/9 / EG
  • the Basic Services Act - Federal 2005 (Federal Law Gazette No. I 100/2005 as amended by Federal Law Gazette I No. 122/2009)
  • the basic service agreement (GVV) between the federal government and the federal states according to Art. 15a B-VG (Federal Law Gazette No. I 80/2004)
  • corresponding state laws

Development, structure and operation

The federal care centers have been run by private operators under the supervision of the Ministry of the Interior since 2003, by European Homecare until 2011 and by the Swiss ORS Service since 2012 .

The Traiskirchen camp and the one in Thalham (St. Georgen im Attergau) were, in addition to their function as a federal care center, until 2015, as well as initial reception centers  (EAST) for asylum seekers ( EAST East and West ). In addition, there were three other institutions with the federal care centers in the north in Bad Kreuzen , south in Reichenau an der Rax and in the center in Vienna.

The initial reception centers served as quarters during the waiting period for the admission procedure for the asylum procedure. From there, asylum seekers admitted to the procedure were accommodated for basic care in around 700 different facilities in the federal states, which are usually managed on a contractual basis with NGOs as part of the task of the states ( as a federal-state agreement ) . Since the refugee crisis in Europe in 2015 , distribution quarters have been created in the federal states to relieve the overcrowded initial reception centers. Due to the Aliens Law Amendment Act 2015 ( Federal Law Gazette I No. 70/2015 ), asylum seekers no longer have to be brought to the initial reception centers; the initial assessment can also be carried out on site in the individual federal states. These distribution areas are also looked after by the ORS.

In mid-August 2015, the Federal Ministry of the Interior declared that “when looking for quarters for people on the move, our federal state's competence in finding solutions is reaching its limits” and called on all social forces to help find quarters for the refugees.

There is also an initial reception center for the airport at Vienna-Schwechat Airport , which was operated directly by the Federal Office for Immigration and Asylum , later by Caritas and since January 2017, like all other federal institutions, by ORS.

Due to the harsh winter, homeless people were also allowed to stay in the care centers in February 2018 until further notice if the usual emergency sleeping places were occupied.

In addition, as part of an asylum cooperation agreement between Austria and Slovakia, a care center in Gabčíkovo is operated by ORS, in which up to 500 asylum seekers can be cared for until the Austrian authorities have completed the asylum procedure.
