Daniel Nicolai

Daniel Nicolai (born April 4, 1683 in Königsberg i. Pr. , † August 1, 1750 ibid) was a German lawyer.

Life

The son of the Prussian archive and hunting secretary Georg Nicolai and his wife Elisabeth (née Mecklenburg) had initially received training from private teachers. Guided by Michael Hoynov and Matthäus Kunstmann, he acquired the knowledge he needed to start studying on April 17, 1699 at the Albertus University in Königsberg . Initially, he concentrated on studying the basics of philosophy. To this end, he attended the lectures of Daniel Hoynovius and Reinhold Stürmer, but also the mathematics lectures given by David Bläsing . After he had worked out the necessary basics and had proven this in a disputation on suicide , he concentrated on studying law.

For this purpose Nicolai attended the lectures on the institutes with Johann Heinrich Hoyer, with Johann Stein he heard the Pandects and feudal law and was instructed in legal practice by Johann Amsel . On March 17, 1706 he moved to the Brandenburg University of Frankfurt , took part in the celebrations on the occasion of the 200th anniversary of the university's founding, and in May of the same year went to the Friedrichs University in Halle . He was mainly drawn here by the celebrities of the time, Samuel Stryk and Christian Thomasius . After he had found accommodation with Johannes Sperlette , he attended the lectures of his role models as well as those of Johann Samuel Stryk , Johann Peter von Ludewig and Justus Henning Böhmer .

When he had proven himself in a number of disputations and demonstrated extraordinary efficiency, on January 3, 1708, Frederick I of Prussia appointed him extraordinary professor at the University of Königsberg. Under Samuel Stryck, he completed his inaugural disputation De obligationibus filii familias on March 28th , after which he received his doctorate in law on April 13th of that year. He then traveled to the University of Leipzig , the University of Erfurt , the University of Marburg , the University of Leiden , the University of Franeker , the University of Groningen and other institutions in order to familiarize himself with the greats of law there. Returning to Königsberg, he held his pro Receptione dissertation de spoliato non restituendo on October 4, 1708 and in February 1709 took over the extraordinary professorship with the Pro loco dissertation de obligatione commendantis .

In addition, he became a lawyer at the court in Königsberg in 1714. On February 5, 1722, he was promoted to counsel at the Prussian Higher Appeal Court, and since he refused, he was appointed royal councilor and court magistrate. In 1724 he was accepted into the local city council as Königsberg city judge and president of the city commercial court. On July 2, 1726, he became a tribunal advisor at the Higher Appeal Court, rose to the fourth full professorship of law at the Königsberg Academy in 1733, became second full professor in the Faculty of Law in 1736 and became mayor of the city of Königsberg in 1741. In addition, he had also participated in the organizational tasks of the Königsberg University and was rector of the Albertina in the summer semesters of 1737, 1741 and 1745.
