Ernesto Garzón Valdés (born February 17, 1927 in Córdoba , Argentina ) is an Argentine-German legal philosopher , political scientist and university professor.

Life

Garzón Valdé studied law , philosophy , political science and sociology in Córdoba, Madrid, Munich, Bonn and Cologne. Until 1974 he was professor of legal philosophy at the Universities of Córdoba and La Plata and a member of the Argentine Foreign Service (including head of the cultural department in the Ministry of Foreign Affairs); In 1974 he was posted to the Argentine embassy in Bonn; A little later, however, he was exposed to political persecution by the Isabel Perón government , with the loss of diplomatic and academic positions, so that he lived in exile in Germany .

After teaching positions at the universities of Bonn, Cologne and Mainz, he was university professor for political science at the Johannes Gutenberg University Mainz from 1981 .

The rehabilitation and resumption of the diplomatic service in the rank of ambassador did not take place until the 1980s under President Alfonsín .

However, Garzón Valdés did not return to active diplomatic service, but stayed as a professor at the University of Mainz and taught as a visiting professor at numerous universities abroad (including Finland, Italy and Spain, Argentina, Chile, Mexico and Peru).

Main focus of work and work

Garzón Valdés' main scientific interest is the analysis of fundamental legal and political science terms (including: legal validity , stability , tolerance , representation , responsibility , equality , corruption , human dignity , terrorism ), political ethics ( legitimacy of political systems , social justice , rule of law ) and the political and social conditions in Latin America (especially Argentina and Mexico ).

In general, Garzón Valdés' work can be seen as a political theory with a legal philosophical foundation. He is a classic liberal who is particularly concerned with the universal protection of the individual against the arbitrariness of state authorities in particular. This is expressed, among other things, in the rejection of group-related rights, but also in the rejection of cultural relativism. He would generally like to locate rights outside the reach of arbitrary definitions by state authorities. At the same time, however, he is skeptical about the positive legal limitation of the state sovereign and is accordingly particularly concerned about the stability of constitutional political systems. Issues such as the relationship between the rule of law and paternalism and tolerance haunted him even before the general boom. The choice of topic is certainly also due to his lifelong involvement in questions of an often very unfortunate Argentine practical policy.
