Eva Leithäuser (born August 14, 1925 in Berlin-Steglitz ; † June 28, 2018 in Hamburg ) was Hamburg's Senator for Justice and judge at the Hamburg Constitutional Court .

Gustav Engelbert Leithäuser's daughter was unable to study after graduating from high school in 1943 because of her mother's "semi-barbaric" descent and initially worked as a secretary and authorized signatory, among others at Philips .

1946–50 she studied law in Berlin and after her legal traineeship she worked as a research assistant in a law firm.

In 1956 she passed the second state examination in law and in November 1957 became a lawyer at the Deutsche Bundespost . For a time she was in front of the large Berlin Post Office 12 (Zimmerstrasse 26–28, Kreuzberg). In the spring of 1970 she was transferred to the Federal Post Office in Bonn , where she had worked as a ministerial director in the human resources department since 1973 . In 1975 she became the first woman president of the Hamburg Oberpostdirektion.

From November 28, 1979 she was Hamburg's Senator for Justice. In 1980, a thousand individual allegations against police officers were investigated under her leadership. On their initiative, marital rape should be criminalized. After the Werner Pinzner affair , she was in public criticism because of the liberal penal system she represented and because of the Hamburg cauldron and resigned as a Senator (as did the Hamburg Interior Senator Rolf Lange ) on August 6, 1986. Leithäuser ran for the SPD in 1982 in the elections for the 10th electoral term of the Hamburg parliament on list position 30. After her work as a senator, she became a member of the Hamburg Constitutional Court . She died in June 2018 at the age of 92.
