Gerhard Hardle

Gerhard Härdle (born August 5, 1941 in Karlsruhe ) is a lawyer in Heidelberg specializing in immigration and asylum law as well as criminal and criminal procedure law . A trial against him attracted more attention nationwide in 1979 and later.

education

Gerhard Härdle graduated from the Helmholtz-Realgymnasium in Karlsruhe in 1960 and then completed his military service until 1961 . He finished his law studies at Heidelberg University , which he began in the summer semester of 1961, with the first state examination in law . The legal preparatory service for court trainees , which he performed in Baden-Württemberg from 1966 , he interrupted for 14 months to study at the École nationale d'administration in Paris . Later he was again in France to prepare his dissertation .

At the end of 1970, Gerhard Härdle passed the legal assessor examination after he had already been the personal assistant to the Rector of Heidelberg University Rolf Rendtorff since October 1970 . After his resignation, Gerhard Härdle worked together with Eberhard Kempf as a lawyer, mainly as a defense attorney for left-wing students or members of the Communist League of West Germany (KBW), to which both belong. The focus of their activities were demonstration offenses or other political crimes . Both were considered defense lawyers by the Heidelberg courts , who exhausted the possibilities of the code of criminal procedure in favor of their clients to the utmost. Mayor Reinhold Zundel called both “ so-called lawyers ” until he was forbidden by a court of law.

Condemnation

Gerhard Härdle was sentenced to probation and a fine in 1978 because of a tussle at a KBW stand during the 1976 federal election campaign , in which a police officer had received a bump . The appeal of this judgment in early 1979 was combined with a trial for an unfair testimony in favor of an expelled student. The trial, which was scheduled for five days, ended on the 48th day of the trial with a one-year and ten-month prison sentence that was not suspended.

Many observers and commentators agreed that this was intended to drive a left-wing lawyer out of the legal profession because of his political views. The appeal filed by Gerhard Härdle was rejected by the Federal Court of Justice in February 1981, a constitutional complaint was not accepted and a petition to the state parliament of Baden-Württemberg was unsuccessful, so that he had to serve a prison sentence . During his imprisonment, G. Härdle worked as an outdoor prisoner at the law firm Erwin Fischer .
