Leo Rosenberg
Leo Rosenberg (born January 7, 1879 in Fraustadt , Posen Province , † December 18, 1963 in Munich ) was a German legal scholar .
Life
After studying law , he received his doctorate in 1900 at the Silesian Friedrich Wilhelms University in Breslau with a thesis on the burden of proof . Here he established the so-called Rosenberg formula , named after him , according to which in principle everyone bears the burden of proof for the existence of the facts favorable to him. After his habilitation in 1906 in Göttingen , he was first associate professor from 1912 , from 1916 full professor and 1926/1927 rector at the Hessian Ludwig University of Gießen , before becoming full professor at the University of Leipzig in 1932 . Because of his Jewish origins, he was forced into retirement in 1934. He survived the National Socialist persecution in Stiefenhofen . His nineteen-year-old daughter died while working and two of his sisters were victims of the Holocaust .
After the war he became a professor at the Ludwig Maximilians University of Munich until his retirement in 1952. He founded the large textbooks on civil procedure law (today: Rosenberg / Schwab / Gottwald, 18th edition 2018) and on enforcement law (today: Gaul / Schilken / Becker-Eberhard, 12th edition 2010).
The Bavarian Academy of Sciences appointed him a full member in 1954. The universities of Munich (1959) and Innsbruck (1963) awarded him an honorary doctorate .
