On November 26, 2011, his club Sport Recife managed to return to the Brazilian first division with a 1-0 draw. That should be celebrated with a big party on the footballer's property. But it came to a scandal with the most serious accusation in Marcelinho's career. He allegedly tried to rape the 31-year-old sister of the local police chief. The suspect protested his innocence and faced up to ten years in prison. However, it soon turned out that the allegations were attempted extortion, which is why he was quickly released from prison. In return, he had sued the police officer.
