The Pirate Bay trial began on February 16, 2009. On April 17, 2009, Sunde and co-defendants were found guilty of "helping to make copyright material available." Each defendant was sentenced to one year in prison and was sentenced to 30 million Swedish kronor in damages (about 2,700,000 euros or 3,600,000 US dollars ), divided among all defendants. A press conference was held following the verdict, at which Sunde held up a handwritten promissory note , stating that this was the full amount of damages he will pay. He also said:

“Even if I had any money I would rather burn everything I own and not even give them the ashes. They could have the job of picking them up. That's how much I hate the media industry. "

“Even if I had any money, I'd rather burn everything I have and not even give them the ashes. You might be given the task of picking them up. That's how much I hate the media industry. "

The defense attorneys ruled at the Svea Hovrätt Court of Appeal to retrial the proceedings before the Regional Court on the suspicion of bias of Judge Tomas Norström, who, without announcing this before the trial, was active in two associations that were concerned with the protection and development of copyright law endeavor. Under Swedish law, judgments do not take effect until all appeals have been resolved. In an appeal in 2010, the sentences were reduced, so Sunde was sentenced to eight months in prison, but the total compensation payment was set at 46 million Swedish kronor (about 5.2 million euros). At the beginning of 2012, another appeal was rejected by the Högsta domstolen Supreme Court , making the judgment final.

In May 2012, Sunde sent the Swedish government a pardon , referring to his health and the business affairs of his company Flattr. In June 2012, Sunde and Fredrik Neij filed a complaint with the European Court of Human Rights (ECHR) , which ruled on February 19, 2013 to reject the complaint as inadmissible. In May 2014, Sweden's Supreme Court upheld the verdict against him.
