The administrative districts in Bavaria are geographically congruent with the districts in Bavaria , but differ in terms of their position in the state structure, tasks and organs / management. They are part of the state administration and therefore not a local authority.

According to Article 9 Paragraph 1 of the Constitution of the Free State of Bavaria, the Bavarian State is divided into administrative districts, referred to there as "Kreise" (original term).

Wherever the constitution speaks of “districts”, the districts are meant.

Before Prussia, Bavaria had divided its area into circles in 1806. During the Nazi era, however, the designation "district" was adjusted to the Prussian designation "administrative district" and in 1939 the "district offices" were renamed uniformly throughout the empire as "districts", which the Constitution of the Free State of Bavaria ignored shortly after the Second World War.

Position in the state structure

An administrative district is an "authority of the Bavarian state administration ". More precisely, this " intermediate authority is located in a three-tier administrative structure between the Bavarian State Ministries and the authorities of the lower tier (e.g. district offices )". In contrast to the district offices, which are state and municipal authorities at the same time, there is only one state authority here, since administrative districts and geographically congruent districts are separated from one another.

In each administrative district there is a government, commonly known as a “ district government ”; in concrete terms, for example, the government of Swabia , the government of Middle Franconia . Difference from the districts

Districts are created “from below”. They are an amalgamation of several rural districts and municipalities, which are spatially predetermined because they are congruent, in order to carry out tasks that they could not do individually. The organ that controls the district, the district assembly, also comes “from below”: it is directly elected by the people.

A government district, on the other hand, comes “from above”. The Bavarian State Government, which is responsible for the entire Free State of Bavaria, installs a government "from above" in order to be able to better enforce its policy in the seven areas of the Free State.
